<br />',~"..."1lo- <br /> <br />. <br /> <br />ORDINANCE NO. 692 <br /> <br />AN ORDINANCE FOR PROTECTING THE PLANNING PROCESS <br />AND THE HEALTH, SAFETY AND WELFARE OF THE <br />RESIDENTS OF THE CITY, PLACING A MORATORIUM ON NEW <br />DEVELOPMENT IN CERTAIN AREAS OF THE CITY OF NEW <br />BRIGHTON IN THE VICINITY OF SILVER LAKE ROAD AND <br />PALMER DRIVE <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS FOLLOWS: <br /> <br />Section 1. Backg:round. <br /> <br />1.01. Properties described below in the vicinity of Silver Lake Road and Pahner Drive, <br />,including the Brighton Village Shopping Center, are zoned B-3, General Business under the <br />zoning code of the City and are guided for community business in the City's Comprehensive <br />Plan. <br /> <br />: 1.02. The business areas of the City are limited in area and are important assets of the <br />: community. <br /> <br />, 1.03. The area of the Brighton Village Shopping Center formerly occupied by a grocery <br />store has been vacant since August of 1999. The departure of that business has prompted <br />. the City to undertake a number of studies to evaluate viable uses and potential developments <br />;for the study area to assure that it will continue to be a viable and important commercial area <br />and will not become blighted or deteriorated or a cause of disinvestment in the community. <br /> <br />1.04. These studies to date have included a Market Analysis by McComb Group, Ltd. dated <br />; November 2000, a study of Supermarket Sales Potential dated September 2000 and <br />development of planning and design standards by Dahlgren,Shardlow & Uban dated May <br />17,2001. <br /> <br />1.05. The City has been presented with a development proposal for the Brighton Village <br />Shopping Center Property and with an application for a special use pennit for development <br />of an automobile service garage across Palmer Drive to the north of the Shopping Center <br />. property. <br /> <br />1.06. The council has determined that current provisions of the Comprehensive Plan, <br />. . Zoning Code and other official controls of the City may not be adequate to prevent <br />inappropriate development or redevelopment of the area covered by this interim ordinance. <br /> <br />1.07. Therefore the council has further detennined that there is a need for additional studies <br />and hearings to be conducted so that the city may adopt appropriate amendments to its <br />comprehensive plan, zoning code and official controls so as to ensure protection of the <br />public, health, safety and welfare.
