'- <br /> <br />~ <br /> <br />ORDINANCE NO...5LL <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />" .,~ <br /> <br />AN ORDINANCE AMENDING CHAPTER 4 <br />TO THE NEW BRIGHTON CITY CODE RELATING <br />TO ALCOHOLIC BEVERAGES <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS THAT <br />THE CODE OF ORDINANCES OF THE CITY OF NEW BRIGHTON, MINNESOTA IS <br />HEREBY AMENDED AS FOLLOWS: : <br /> <br />Section 1. In Article I, Section 4-1, the following definitions are hereby amended <br />to read as follows: <br /> <br />Beer or nonintoxicating malt liquor: Any malt beverage with an alcoholic <br />content of tft6f"e not less than one-half of one percent by volume and not more than <br />3.2 percent by weight. <br /> <br />Club: Any corporation duly organized under the laws of the state for civic, <br />fraternal, social or business purposes or for intellectual improvement or for the <br />promotion of sports, which has been in existence for more than fifteen (15) years, <br />and any congressionally chartered veterans organization which as been in existence <br />for more than ten (lO) years prier te Jaru:itlry 1, 1961, which shall have more than <br />fifty (50) members, and which shall, for more than a year have owned, hired, or <br />leased a building or space in a building of such extent and character as may be <br />suitable and adequate for the reasonable and comfortable accommodation of its <br />members and whose affairs and management are conducted by a board of directors, <br />executive committee, or other similar body chosen by the members at a meeting <br />held for that purpose, none of whose members, officers, agents or employees are <br />paid directly or indirectly any compensation by way of profit from the distribution <br />or sale of beverages to the members of the club or to its guests, beyond the amount <br />of such reasonable salary or wages as may be fixed and voted each year by the <br />directors or other governing body. <br /> <br />Restaurant: Any establishment, other than hotel or motel, under the control <br />of a single proprietor or manager, having appropriate facilities to serve meals and <br />for seating not less than one hundred fifty (159) twenty-five (12S) guests at one <br />time, and where in consideration of payment therefor, meals are regularly served <br />at tables to the general public, and which employs an adequate staff to provide the <br />usual and suitable service to its guests, and the principal part of the business of <br />which is the serving of food. <br /> <br />Section 2. Section 4-6, is hereby amended to read as follows: <br /> <br />Section 4-6. Certain persons excluded. <br /> <br />No person of a known immoral character or any disorderly person shall be <br />permitted on th.e preffl.ises ef th.e municipal dispensary or any ather any premises <br />coming under the provisions of this chapter. <br />
