'- ~ ORDINANCE NO...5LL CITY OF NEW BRIGHTON COUNTY OF RAMSEY STATE OF MINNESOTA " .,~ AN ORDINANCE AMENDING CHAPTER 4 TO THE NEW BRIGHTON CITY CODE RELATING TO ALCOHOLIC BEVERAGES THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS THAT THE CODE OF ORDINANCES OF THE CITY OF NEW BRIGHTON, MINNESOTA IS HEREBY AMENDED AS FOLLOWS: : Section 1. In Article I, Section 4-1, the following definitions are hereby amended to read as follows: Beer or nonintoxicating malt liquor: Any malt beverage with an alcoholic content of tft6f"e not less than one-half of one percent by volume and not more than 3.2 percent by weight. Club: Any corporation duly organized under the laws of the state for civic, fraternal, social or business purposes or for intellectual improvement or for the promotion of sports, which has been in existence for more than fifteen (15) years, and any congressionally chartered veterans organization which as been in existence for more than ten (lO) years prier te Jaru:itlry 1, 1961, which shall have more than fifty (50) members, and which shall, for more than a year have owned, hired, or leased a building or space in a building of such extent and character as may be suitable and adequate for the reasonable and comfortable accommodation of its members and whose affairs and management are conducted by a board of directors, executive committee, or other similar body chosen by the members at a meeting held for that purpose, none of whose members, officers, agents or employees are paid directly or indirectly any compensation by way of profit from the distribution or sale of beverages to the members of the club or to its guests, beyond the amount of such reasonable salary or wages as may be fixed and voted each year by the directors or other governing body. Restaurant: Any establishment, other than hotel or motel, under the control of a single proprietor or manager, having appropriate facilities to serve meals and for seating not less than one hundred fifty (159) twenty-five (12S) guests at one time, and where in consideration of payment therefor, meals are regularly served at tables to the general public, and which employs an adequate staff to provide the usual and suitable service to its guests, and the principal part of the business of which is the serving of food. Section 2. Section 4-6, is hereby amended to read as follows: Section 4-6. Certain persons excluded. No person of a known immoral character or any disorderly person shall be permitted on th.e preffl.ises ef th.e municipal dispensary or any ather any premises coming under the provisions of this chapter.
