<br />~ <br /> <br />... <br />. . <br />III' <br /> <br />, . <br /> <br />ORDINANCE NO. 549 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING SECTION 17, NUISANCES, <br />OF THE CITY CODE. <br /> <br />The City Council of the City of New Brighton hereby ordains: <br /> <br />Section 17 of the City Code is amended to include an Article IV, Providing for <br />the Removal of Weeds. <br /> <br />ARTICLE IV. IN GENERAL <br /> <br />Section 17-60. <br /> <br />The Weed Inspector or his delegated assistant may inspect all premises <br />and places within the City for the presence of weeds, as defined below: <br /> <br />The term "weeds" as used in this Code shall include: <br /> <br />a. Any tall weeds or grass growing upon any lot or parcel of land in <br />the City to a height greater than 12 inches. <br /> <br />b. Such other vegetation as the Council shall, from time to time, <br />designate by Resolution. <br /> <br />Section 17-61. <br /> <br />The Weed Inspector or his delegated assistant shall notify the affected <br />property owner that weeds which are on his property, must be eradicated, <br />or controlled, in the manner prescribed by the inspector. <br /> <br />a. The notification shall require abatement of the weeds, or other <br />prescribed action, within ten (10) days from date of mailing notice. <br /> <br />The notification shall state that the City will take appropriate <br />remedial action to eradicate or control the weeds upon expiration of <br />said ten (10) days, with a charge to the property owner for costs. <br /> <br />Section 17-62. <br /> <br />Eradication notice for noxious weeds as described by Section 17-60, shall <br />be made in accordance with the provisions of Minnesota Statutes, Chapter <br />18.271. <br /> <br />Notice for eradication or control of all other weeds shall be made by <br />certified mail to the property owner. If the owner is not in possession <br />of the property, then a copy of the notice shall be sent to the lessee, <br />occupant, or agent of the owner of the premises. <br />
