For the purposes of Sections 355:00 through 355:10 <br />the terms defined in this section shall have the meanings given <br />them.. <br /> <br />Subd.. 2. "On Sale Wine License" shall mean licenses <br />authorizing the sale of wine not exceeding fourteen (14) per cent <br />alcohol by volume, for consumption on the licensed premises on~~, <br />and in conjunction with the sale of food. <br /> <br />Subd. 3.. "Restaurant" shall mean an establishment under <br />the control of a single proprietor or manager, having appropriate <br />facilities for serving meals and seating not fewer than twenty-fi e <br />(25) guests at one time and where, in consideration of payment <br />therefore, meals are regularly served a:t tables to the general <br />public, and which employs an adequate staff to provide usual and <br />J. <br />suitable service to its guests. <br /> <br />Subd.., 4. "Seating" shall mean the usual and regularly <br />available seating accommodations for guests of the establishment <br />to sit at tables for the purpose of eating meals.. <br /> <br />Section 355:02. License Required <br /> <br />Subd. 1.. No person except wholesalers or manufacturers to <br />the extent authorized under Sta,te license, e~cept the municipal <br />liq90r dispensary, ,and except those having an on-sale intoxicatin <br />liquor license in accordance with Section 330, whall directly or <br />indirectly deal in, sell, or keep for sale any wine withQut firs <br />having a license to do so as provided for in Section 355.. <br /> <br />Subd.. 2.. "On sale wine licenses'" shall be issued only to <br /> <br />
