': <br /> <br />~ <br /> <br />" <br /> <br />" " <br />,> <br /> <br />ORDINANCE NO <br /> <br />349 <br /> <br />I <br />II <br />!! <br />II <br /> <br />I AN ORDINANCE AMENDING CHAPTER III, ADDING SECTION 2-695 AND <br />AMENDING SECTIONS 2-680 AND 2-690 OF THE NEW BRIGHTON ZONING CODE <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />The New Brighton City Council does ordain; <br /> <br />Section l, Section 2-680 of the New Brighton Zoning Code <br />is hereby amended to read as follows: <br /> <br />,. <br />SECTION 2~680. Use, Conforminq. Any use of land, structur <br />or combination thereof which is in compliance with all applicable <br />portions of the Zoning Code. <br /> <br />Se~tion 2. Section 2-690 of the New Brighton Zoning Code is <br />hereby amended to read as follows; <br /> <br />SECTION 2-690. Uses, Non-Conforminq. Any use of land, <br />structure or combination thereof which was lawful1y established a <br />;1 which does not comply with all applicable portions of the Zoning <br />I Code. <br /> <br />H <br />'J <br />P <br />II <br />Ii <br />! <br /> <br />Section 3. Chapter II of the New Brighton Zoning Code is <br />hereby amended by adding Section 2-695 which shall read as follow <br /> <br /> <br />SECTION 2-695. Use, Discontinued. A use shall be considere <br />to be discontinued when the premises are not regularly occupied 0 <br />when the characteristic equipment and furnishings of such usehav <br />been removed from the premises. <br /> <br />I Section 4. Purpose and Intent. It is recognized that <br />there are uses of land, structures and combinations thereof whic <br />were lawfully established and which do not now comply with all <br />applicable portions of the Zoning Code. <br /> <br />While it is recognized that such non-conforming uses may not be <br />summarily terminated, it is the purpose and intent of this chapte <br />to discourage their survival. Such uses are hereby declared to b <br />incompatible with the Zoning Code. It is further the purpose and <br />intent of this chapter to discourage the enlargement, expansion <br />of, extension of any non-conforming uses or any increase of :t.he <br />impact of such non-conforming uses on adjoining premises.
