Section 1: Section 490: 05 of the 1966 Code of Ordinal ces <br />!'I is hereby amended to read as follows: <br />l <br />" <br />II SECTION 490: 05. Fencing:. All outdoor inground or partially <br />'I inground (partially inground is defined to height of not more than <br />\3 feet above ground) swimming pools existing and hereafter <br />lconstructed shall be completely enclosed by a (non-climbing type <br />IOf) fence or wall. All fence openings or points of entry into the <br />Ilpool area enclosure shall be equipped with gates . The fence and <br />19ates shall be at least five (5) feet in height and shall be <br />constructed of materials approved by the Building Inspector. All <br />,gates shall be equipped with self-closing and self-latching devices <br />l!placed on the top of the gate or otherwise inaccessible to small <br />Ii children. All fence posts shall be decay or corrosion resistant <br />!Iand shall be set in concrete bases, or other suitable protection. <br />II The opening between the bottom of the fence and the ground or <br />ilother surface shall be not more than four inches. <br />II <br />I:,!" Section 2: Section 490: 15 of the 1966 Code of Ordinances <br />lis hereby amended to read as follows: <br /> <br />'," Subd. 1. No person shall operate or maintain a public <br />swimming pool unless he has obtained the appropriate operation <br />!permit from the Health Authority. Such permits shall be valid <br />lifor one year from the time of issuance. Such permits are not <br />t; <br />!!transferable. <br />!l <br />Ii Subd. 2. No permit to operate a public swimming pool shall <br />II be granted unless the pool conforms with the regulations adopted <br />lin Section 490:10, Subd. 4. <br />II <br />(I <br />I! ,SUbd. 3. The fee for a permit to conduct, operate and <br />jlmaintain a public swimming pool shall be $50.00 per year. <br /> <br />, Section 3.
