"!. .li <br />t- <br /> <br />.~ <br /> <br />...:;: <br /> <br />~ <br /> <br />ORDINANCE NO. <br /> <br />305 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />VILLAGE OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING THE 1966 NEW BRIGHTON CODE OF ORDINANCES BY <br />ADDING SECTION 882 PROHIBITING THE SALE OF CERTAIN NON-RETURNABLE <br />DISPOSABLE BEYERAGE CONTAINERS, P~OVIDING FOR THE REDEMPTION OF <br />RETURNABLE CtilNTAINERS, PROVIDING FOR INSPECTIONS, AND PROVIDING <br />PENALTIES FOR VIOLATIONS OF THE PROVISIONS THEREOF. <br /> <br />The New Brighton village Council does ordain: <br /> <br />SECTION 1. The 1966 New Brighton Code of Ordinances is hereb <br />amended by adding thereto Section 882, which shall read as follows: <br /> <br />Section 882: <br /> <br />Non-Returnable containers. <br /> <br />Section 882:00 <br />sale, distribute or <br />beverage containers <br />Brighton <br /> <br />prohibitions. No person shall sell, offer for <br />donate beverages in non-returnable or disposab e <br />as herein defined within the Village of New <br /> <br />Section 882:02. Redemption. No person shall refuse to <br />redeem a specific returnable beverage container~ provided such <br />beverage container is offered for sale by such person. <br /> <br />Section 882:04. Definitions. The following definitions <br />shall apply in the interpretation and enforcement of this ordinanc <br />and the following words and terms whereve"r' they occur in this <br />ordinance are defined as follows: <br /> <br />(a) Beverage shall mean all alcoholic and non-alcoholic <br />beverages as herein defined. <br /> <br />(b) Non-9,lcoholic beverage shall mean any mineral waters, <br />distilled waters, spring water and any bottled drinking <br />waters, any soda or tonic waters, or any carbonated or <br />uncarbonated beverage not containing alcohol that is <br />commonly known as a soft drink, pop, cola, soda pop, sod , <br />near beer or a mix~ provided, however, that orange juice, <br />tomato juice and other fruit and vegetable juices shall <br />not be deemed a mix for the purpose of this Ordinance. <br /> <br />(c) Alcoholic beverage shall mean any beer, ale. or other <br />malt beverage containing one-half of one per centum or <br />more of alcohol by volume. <br /> <br />(d) container shall mean any device or material used for the <br />purpose of holding or containing a beverage. <br /> <br />(e) Non-Returnable or Disposable beverage cQntainer shall <br />mean any container which is or has at one time been <br />sealed, the title to which the seller intends to pass <br />with the sale of the contents, and which is not suitable <br />or is not intended for refuse. <br />
