FINDINGS <br /> Section 5-360 Development Regulations in a B-4 Downtown Business District <br /> Section 7-250 (2) Amendment to the approved final plan of Planned Unit <br /> Development <br /> EFFECT OF APPROVAL OF A GENERAL DEVELOPMENT PLAN. <br /> Within Section 5-360, no construction or expansion of buildings on land for which a <br /> general development plan has been approved that does not conform to the approved final <br /> plan. Development of land for which a general development plan has been approved that <br /> does not conform to the approved final plan shall only be allowed if an amendment to the <br /> approved final plan as provided. <br /> On June 26, 2001, the Council approved a General Development Plan for Main Street <br /> Village. The applicant is proposing several changes to the site plan; the Zoning Code <br /> stipulates that the developer apply to amend the final approved plan so the City Council <br /> can review and determine if the proposed changes fit within the overall general <br /> development plan for the B-4 district. <br /> STAFF COMMENTS <br /> Pratt Ordway wishes the City to consider an amendment to the General Development <br /> Plan/PUD for Main Street Village to allow the restaurant component of the project to be <br /> located in building E and a retail post office component to be located in Building D. <br /> This proposal is in conflict with the approved General Development Plan/PUD for Main <br /> Street Village. Pratt Ordway, would like to modify the approved plan to accommodate a <br /> different tenant mix in Building D and E (Lot 4, Block 1, Main Street Village First <br /> Addition). <br /> More specifically this change would allow Pratt Ordway to: <br /> 1. develop a stand-alone post office for Building D (previously proposed as a <br /> restaurant site); and, <br /> 2. lease space within Building E (previously proposed as retail) for a restaurant <br /> and adjoining deli. <br /> As long as the Council accepts the land use"swap" for the buildings, staff believes there <br /> is no significant change to the overall plan.
