Motion by Schiferl, second by Baker to <br />CLOSE THE PUBLIC HEARING. <br /> <br />7 Ayes, 0 Nays, <br />MOTION CARRIED. <br /> <br />After discussion, Motion by Schiferl, Second by O’Brien, <br />TO WAIVE THE READING AND <br />ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP-03-09 with the <br />FOLLOWING CONDITIONS: <br /> <br />The applicant shall resubmit the site plan survey indicating the final approved <br />1. <br />dimensions. <br />Conversion of attached garage to living space, subject to building plan schedule <br />2. <br />approved by staff. <br />The excess driveway beyond 30’ wide would be removed. <br />3. <br /> <br />Public Hearing: Type 4 Nonconforming Use Permit – NC 03-02 – Oscar Noyed <br />Consideration of a request for a Type 4 nonconforming use permit to construct a detached <br />th <br />accessory structure on a single family lot at 2260 7 Street NW. <br />Mr. Boylan presented the background information as follows. <br />The site is zoned R-1, Single Family Residential. The applicant has three accessory <br />structures on site, which consists of two sheds and a one stall detached garage. The <br />zoning code allows no more than one detached accessory building per lot. The zoning <br />code also states that any construction of new structures where Type 4 nonconformities <br />exist shall be allowed only upon permission of the City Council. The Planning <br />Commission recommended approval of a Special Use Permit for a 24’ by 30’ detached <br />structure (720 sq. ft) on August 19, 2003. Since that time, it became apparent that the <br />applicant should have applied for both a Special Use and a Type 4 Nonconforming Use <br />Permit. The applicant is proposing to reduce the total number of nonconformities by <br />removing the two smaller sheds and replacing them with one larger structure. <br /> <br />Motion by Baker, Second by O’Brien to <br />CLOSE THE PUBLIC HEARING. <br /> <br />7 Ayes, 0 Nays, <br />MOTION CARRIED. <br /> <br /> <br />Motion by Zisla, Second by O’Brien <br />TO WAIVE THE READING AND ADOPT THE <br />ATTACHED RESOLUTION RECOMMENDING APPROVAL OF NC 03-02 WITH THE <br />FOLLOWING CONDITION: <br /> <br />1.
