Approved
Mr. Lynn Peterson, 1801 Long Lake Road, has concerns regarding to grading for the new
house and wondered if they had decided which mature trees on the property would be
taken down. Mr. Pignatello responded that they would level the property and direct drain
towards Long Lake Road and the back of the property. He also stated that he has not
made a decision on what trees would be removed, but some of them would need to be
taken down. Mr. Pat Glastar, 1789 Long Lake Road, approached the commission to
voice his support of this project.

CLOSE THE PUBLIC HEARING.
Motion by Baker, Second by Howard to

MOTION CARRIED.
7 Ayes, 0 Nays,

After some further discussion between commissioners and staff, there was a Motion by
to WAIVE THE READING AND ADOPT THE
Baker, Second by Mann
ATTACHED RESOLUTION APPROVING VN05-02.

MOTION CARRIED.
7 Ayes 0 Nays,

Public HearingSP 05-13 Special Use Permit for two car sales events at Main

:
Street Village

Consideration of a Special Use Permit application for two separate car sales events. Each
event will be one day in duration and are proposed to be held once in the fall and once in
the spring in the parking lots of Main Street Village. The sale event is proposed to run
during the hours of 8:00 AM to 4:30 PM in the fall and spring each year. The CU
Companies-owned lots has 332 parking stalls available for sales staff, buyers, and sale
items. The applicants are proposing to hold events that will encompass between 125 and
175 vehicles. The applicant has conducted several such events in other communities and
held a successful event in New Brighton on May 21, 2005.

Commissioner Baker asked what the City would do if it is decided at a later date that the
sale was being mishandled. Mr. Boylan responded that the City would pull the Special
Use License and the company would no longer be able to hold the sale. Council Member
Burg stated that Council had considerable discussions about reviewing each sale and
watching how the sales were being handled when the May application was before them.
This application is a different format than how the Council had considered processing it.

Commissioner Howard inquired if the City had any control over the dates of the sale.
Mr. Boylan recommended that if this is a concern of the Commission that they add a
condition of approval stating that the date will need to be approved by staff ninety days
before the sale. Mr. Chuck Abbott, CU Companies, approach the Commission and stated
that they would not have a problem with a ninety day notice to the City. He then gave a
brief synopsis of the previous sale.

2
I:\COMMISSIONS\PLANNING\Minutes\2005\7-19-05.doc
