Preliminary and Final Plat (PL2007 -001, FP2007 -001), Site Plan (LP2007 -001), Variance (VN2007 -001), and Nonconforming Use Permit (NC2007 -001) to permit construction of a building addition connecting the existing two industrial buildings located at 52 8s 55 Mounds Avenue for Norm Wells, acting on behalf of Manfred Neidernhoefer. Report No. 07 -108. Resolution No. 07 -042. City Planner, Janice Gundlach reported the original application was heard at the April 10, 2007 Council meeting. That item was tabled in order to allow staff sufficient time to evaluate the park dedication requirements. It was stated that the ordinance now allows for the council to reduce the fee depending on the characteristics of the project. Ms. Gundlach suggested reducing the fee by assessing the applicant only for the redevelopment portion, equal to .3 acres, resulting in a total park dedication fee of approximately $3,680. Councilmember Doffing stated she feels the fee of $3,680 is reasonable. Councilmember Hoffman shared her thoughts that the .3% was a fair amount of land to assess. City Attorney, Charlie LeFevere recommended the following 2 amendments be made to the resolution. MWTiefirst be&V a4jusitn9 the fee from $12,278 to $3,683. Erhe second being to add findvW # 13. Because the subdivision involves expansion of W�xistzng rather than a new developmen4 it is reasonable and appropriate to reduce the park deduython fee from the amount set in city policy to the amount set forth in paragraph 6 below. Motion by Councilmember Bauman, seconded by Councilmember Hoffman to to adopt the attached amended resolution approving the project subject to 8 conditions, and to calculate park dedication fees for new land use only based on the .3 acres affected, resulting in the amount of $3.683.
