Page 5 — May 8, 2007 New Brighton Council Minutes <br />4. Preliminary and Final Plat (PL2007 -001, FP2007 -001), Site Plan <br />(LP2007 -001), Variance (VN2007 -001), and Nonconforming Use Permit <br />(NC2007 -001) to permit construction of a building addition connecting <br />the existing two industrial buildings located at 52 8s 55 Mounds <br />Avenue for Norm Wells, acting on behalf of Manfred Neidernhoefer. <br />Report No. 07 -108. Resolution No. 07 -042. <br />City Planner, Janice Gundlach reported the original application was heard at the <br />April 10, 2007 Council meeting. That item was tabled in order to allow staff sufficient <br />time to evaluate the park dedication requirements. It was stated that the ordinance <br />now allows for the council to reduce the fee depending on the characteristics of the <br />project. Ms. Gundlach suggested reducing the fee by assessing the applicant only for <br />the redevelopment portion, equal to .3 acres, resulting in a total park dedication fee of <br />approximately $3,680. <br />Councilmember Doffing stated she feels the fee of $3,680 is reasonable. <br />Councilmember Hoffman shared her thoughts that the .3% was a fair amount of <br />land to assess. <br />City Attorney, Charlie LeFevere recommended the following 2 amendments be made <br />to the resolution. <br />MWTiefirst be&V a4jusitn9 the fee from $12,278 to $3,683. <br />Erhe second being to add findvW # 13. Because the subdivision involves expansion of <br />W�xistzng rather than a new developmen4 it is reasonable and appropriate to reduce the <br />park deduython fee from the amount set in city policy to the amount set forth in <br />paragraph 6 below. <br />Motion by Councilmember Bauman, seconded by Councilmember Hoffman to <br />to adopt the attached amended resolution approving the project subject to 8 conditions, <br />and to calculate park dedication fees for new land use only based on the .3 acres <br />affected, resulting in the amount of $3.683. <br />S Ayes - 0 Nays, Motion Carried <br />Right -of -way Vacation of Mounds Avenue (VA2007 -001), that portion of <br />which is located at the intersection of Old Highway 8 NW. Report No. <br />07 -109.
