MOTION CARRIED. <br />The Commissioners debated if the shed should be required to meet the five foot set back. O'Keefe stated that <br />he felt the shed should be allowed to remain where it is currently located, Zisla replied that he disagrees and <br />believes the shed should meet the 5 foot setback. Schiferl stated that he agrees with Zisla and the setback <br />should be maintained. Baker agreed that the setback should be maintained or the ordinance would need to be <br />changed. Gundlach replied that when citizens make inquiries regarding sheds they are made aware of the <br />ordinance to meet the setback, but since sheds 10 x 12 and smaller do not require a permit it is difficult to <br />regulate. <br />Motion by Schiferl, second by Howard to ADOPT SP2007-008, NC2007-002 RECOMMENDING APPROVAL OF <br />THE SPECIAL USE PERMIT AND NONCONFORMING USE PERMIT, SUBJECT TO THE FOLLOWING: <br />1. The detached garage cannot exceed the height of the existing home or 30 feet, whichever is less. <br />2. If structurally possible, the 64 s1 shed be moved to meet a 5' setback. <br />6 ayes, 0 nays. MOTION CARRIED. <br />Public Hearing: ZA2006-003 Establishment of Northwest Quadrant Zoning District <br />The City is requesting consideration of a new Article 6 to the Zoning Code, titled NWQ, Northwest Quadrant <br />,,,District. Adoption of this code would establish a new zoning district specifically for the area known as the <br />rthwest Quadrant. This code is very specific and aims to codify the design guidelines of the NWQ <br />ramework Plan that was adopted by the City Council in December of 2005. Establishment of this ordinance <br />will allow development to progress under a more defined set of standards. Following adoption of this ordinance <br />the City will rezone the area within the Northwest Quadrant from MX, Mixed Use to NWQ, Northwest <br />Quadrant. <br />The Commission considered this code in February and March of 2006. Subsequent to the Commission's <br />recommendation to adopt the code, City staff, and consultants began re-working the site layout on the east side <br />of Old Highway 8. Re-working the site plan was in response to environmental issues related to the dump clean <br />up and the Pollution Control Agency's setback standards from remediated contamination and residential uses. <br />During the course of the last year, the proposed road layout is becoming more fixed helping to define blocks, <br />however it has become apparent that flexibility in development regulations is necessary. This is due to <br />consideration of development proposals in the future and the planned clean up of the dump. <br />O'Keefe inquired if there are controls in place to protect the tenants that will be residing in the condo building <br />that would have the retail. Gundlach replied that the building and nuisance code would address most issues that <br />may occur. She added that the tenants that purchase the units would have to be made fully aware of the types of <br />businesses that may go into the site. <br />Schiferl asked what the status of the library is for moving into the development. Gundlach replied that the <br />library would not be moving into the development, she believes it was due to funding issues with Ramsey <br />,County, but is not fully aware of the history. <br />Thiferl stated there has been talk of a retail area offering a community gathering place and questioned if that <br />would occur. Gundlach replied that the way the code is drafted, there would be retail. She added that building <br />Page 3 of 4
