/o/-77 <br />DIVISION D. RANDICAPPED PARKING <br />Added by Ord. No. 76-7, 3-22-76 <br />SEC. 8.88.01. DEFINITIONS. <br />The following words and terms as used in this Division shall have the following meanings unless the con-,.';.. <br />text clearly indicates otherwise. �i`•?` <br />-�r <br />Identifying Certificate --the certificate or insignia issued to physically handicapped persons by, the <br />Minnesota Department of -Public Safety pursuant to M.S.A. §169.345, Subd. 2. <br />Physically Handicapped --any person who has.sustained an amputation or permanent material disability of <br />either or both arms or legs or who has been otherwise permanently.disabled in any manner rendering it diffi-, <br />cult and,burdensome for him to walk. <br />SEC. 8.88.02. PARKING RESTRICTIONS. <br />(a) The following parking restrictions shall apply.to both public and private property; the restrictions <br />shall apply to parking spaces designated and reserved for physically handicapped persons by state and local k. <br />law and to those spaces created through the action of persons who own or are in lawful possession of,the subs ? <br />ject property. <br />(b.) No person shall park a motor vehicle in parking psaces designated and reserved for the physically <br />handicapped unless: <br />(1) Thal; person is physically handicapped or is operating the vehicle under the direction and for the <br />use of a physically handicapped person, and <br />(2) Such vehicle visibly bears or contains a proper identifying certificate. <br />(c) Failure to obey the above provisions shall constitute a petty misdemeanor.. Vehicles in violation may <br />be removed; impounded, and kept in custody under the direction of the Police Chief. <br />(d) In any prosecution charging a violation of the above provisions, proof of the identity of the regis- <br />tered owner of the particular vehicle described in the citation or complain at the tine of the violation <br />shall create a prima facie presumption that that individual was the person who parked such vehicle at the <br />point where the violation occurred. <br />SEC. 8.88.03. DESIGNATION OF LOCATION AND DESCRIPTION OF SIGNS. <br />(a) The location of parking spaces reserved for physically handicapped persons shall be designated ac - <br />Uniform provisions of the Uniform Building Code as incorporated by Chapter 35 of this Code. <br />(b) Notice of such designation of handicapped parking spaces shall be given by the posting of permanent, <br />nonportable signs. Such signs shall be designed in accordance with the requirements of the manual of the <br />Commissioner of Public Safety on uniform traffic control devices. <br />(c) No person shall cause to be erected signs reserving or designating parking spaced'for physically <br />handicapped persons unless the location, number, and method of signing of such spaces is first approved by �O. <br />the Director of Community Development or an appointed representative. <br />AIN G ��b <br />
