Council Proceedings <br />City of New Brighton <br />Jan. 25, 1977 <br />Mayor Bromander asked how access could be provided <br />to the site. <br />Swenson stated that the 30 -foot private road easement in <br />New Brighton could possibly be combined with additional <br />30 feet in the City of Mounds View. <br />Councilman Fisher inquired as to how much longer <br />the landfill operation would continue. <br />Swenson stated there was no way of knowing with any <br />certainty but he expected several more years. <br />Motion by Hardt, seconded by Werdouschegg to <br />close hearing <br />5 ayes - 0 nayes- carried <br />Councilman Werdouschegg asked what the applicant <br />was intending to do with the property. <br />Swenson stated that the applicant had not thought that <br />far ahead, but was simply acquiring the additional <br />property because there was opportunity to do so. <br />i24vq- 3 <br />Close hearing <br />Motion by Hardt, seconded by Fisher to direct <br />administration to draft a resolution approving VN -168 with <br />the following findings of fact: <br />1. That the location and shape of Skiba parcel is such <br />that access to the Herbst property cannot be provided <br />except by moving the Skiba house, which constitutes <br />a hardship; <br />2. That the variance satisfies the intent of the <br />platting regulations in that no new landlocked parcels <br />are created and the conditions which follow provide <br />the potentiality of future public access which helps <br />to alleviate the access problem, <br />and that the resolution contain the following conditions: <br />1. That the owners of the Skiba and Herbst properties <br />enter into an agreement with the City of New Brighton <br />that a 30 -foot public road easement will be dedicated <br />to the City along the north property lines should it <br />be deemed necessary in the future by the City Council; <br />2. That the property being sold from Skiba to Herbst <br />be joined with the other Herbst property. <br />5 ayes - 0 nayes - carried <br />
