February 3, 1977 TO: Thomas F. Lewcock, City Manager FROM: James F. Winkels, City Planner RE: Motor Vehicle Dealer's License - Cross Texaco Prior Council Action On January 11, the Council took the following action regarding the motor vehicle dealer's license application of Cross Texaco: "Motion by Werdouschegg, seconded by Fisher, to defer action on consideration of resolution entitled Resolution Approving 1977 New and Used Car Sales License For Cross Texaco, 500 8th Avenue NW, and to direct Administration to prepare a report regarding criteria that should be followed to avoid site obstructions, parking requirements on the site and prepare a parking plan." 5 ayes - 0 nayes �-_ carried "Motion by Hardt, seconded by Fisher, to direct administration to include in its report on Cross Texaco new and used car license a discussion of the Zoning Code requirements for a special use permit for new and used car sales and that requirements applicability to the subject case." 5 ayes - 0 nayes - carried Site Obstruction Pertaining to this case, there appear to be two relevant sections of the Zoning Code relative to site obstructions. These sections read as follows: "Section 12-030(d). There shall be no off-street parking lot within fifteen (15) feet of any street right-of-way." "Section 13-060. Obstruction of View. On any corner lot, no wall, fence or other structure shall be erected or altered and no hedge, tree, shrub or other growth shall be maintained which may cause danger to traffic on a street or public way by obscuring the view." In addition, the 30 foot front yard and street corner yard setback would seem to define an area that should be free of site obstructions.
