Winkels, City Planner <br />RE: Motor Vehicle Dealer's License - Cross Texaco <br />Prior Council Action <br />On January 11, the Council took the following action regarding <br />the motor vehicle dealer's license application of Cross Texaco: <br />"Motion by Werdouschegg, seconded by Fisher, to defer <br />action on consideration of resolution entitled Resolution <br />Approving 1977 New and Used Car Sales License For Cross <br />Texaco, 500 8th Avenue NW, and to direct Administration <br />to prepare a report regarding criteria that should be <br />followed to avoid site obstructions, parking requirements <br />on the site and prepare a parking plan." <br />5 ayes - 0 nayes �-_ carried <br />"Motion by Hardt, seconded by Fisher, to direct administration <br />to include in its report on Cross Texaco new and used car <br />license a discussion of the Zoning Code requirements for <br />a special use permit for new and used car sales and that <br />requirements applicability to the subject case." <br />5 ayes - 0 nayes - carried <br />Site Obstruction <br />Pertaining to this case, there appear to be two relevant <br />sections of the Zoning Code relative to site obstructions. These <br />sections read as follows: <br />"Section 12-030(d). There shall be no off-street parking <br />lot within fifteen (15) feet of any street right-of-way." <br />"Section 13-060. Obstruction of View. On any corner lot, <br />no wall, fence or other structure shall be erected or <br />altered and no hedge, tree, shrub or other growth shall <br />be maintained which may cause danger to traffic on a <br />street or public way by obscuring the view." <br />In addition, the 30 foot front yard and street corner yard <br />setback would seem to define an area that should be free of site <br />obstructions. <br />
