Council Proceedings <br />City of New Brighton <br />Feb. 22, 1977 <br />K <br />Motion by Fisher, seconded by Hardt to waive reading of lst reading <br />ordinance and to hold first reading of an ordinance Ordinance <br />entitled AN ORDINANCE AMENDING SECTION 400:00 OF THE Minn. Building <br />1966 CODE OF ORDINANCES OF THE CITY OF NEW BRIGHTON IN Code <br />REGARDS TO ADOPTION OF THE MINNESOTA BUILDING CODE. <br />5 ayes- 0 nayes—carried <br />Public Hearing <br />City Attorney stated hearing remained properly called. <br />TheDDirector of Community Development reviewed the Falcon Oil <br />planning report and recommendations. <br />Mayor Bromander inquired as to whether there were sign <br />nonconformities on the property. <br />The Director stated that there were but at the present time they 8.07 to <br />were not included as part of the nonconformity land use 9:05 <br />procedure. <br />Councilman Werdouschegg asked how the canopy could be <br />build without the setback variance. <br />The Director stated that the options were to change the <br />canopy or change the location of the pump islands. <br />Councilman Fisher asked whether it was feasible to move <br />the canopy back. <br />The Director stated that there appeared to be enough room <br />to do so. <br />Rick Ahlberg, general manager for Falcon Oil, and Mike Snow, <br />attorney representing Falcon Oil, were present to discuss <br />the proposal. <br />Ahlberg stated hardship existed because of the present <br />location of the pump island noting that it was economically <br />unfeasible to move them. He stated Falcon Oil had <br />already purchased a 24 x 65 foot custom designed canopy <br />for the project. He stated to move the canopy to the east would <br />create traffic problems. <br />Snow stated that Falcon Oil intended to remove the southern driveway <br />on Silver Lake Road and noted that the driveway on Rice Creek <br />Road was within 3 to 4 feet of code requirements. He added <br />the concrete curb would be constructed to code. <br />He noted that the original construction of the <br />station permitted a large buffering to the rear of the property. <br />He pointed out that the property owners in the area were personally <br />contacted relative to this proposal and that no opposition was found. <br />He showed pictures of where the. canopy would be located on <br />the property noting that lighting would be recessed. He <br />pointed out the canopy would not create a sight obstruction. <br />He stated this location might be unique because many other <br />stations had pump islands on two sides and aould construct canopies <br />within code. He noted that others were far closer to the road <br />than Falcon Oil. He stated that to remove the pump island would <br />require removing the tanks and this was a cost that a small <br />business could not bear. <br />
