There has been no significant change in the application, <br />in the neighborhood or in the conditions since <br />February 1976 when an earlier license application <br />was denied. <br />5. The impact on the neighborhood due to lights, late <br />hours, noise and the character of traffic generated <br />would be negative. <br />6. Parking could occur within the residential <br />area. <br />7. The license would not be in the best interest of the <br />community. <br />5 ayes - 0 nayes- carried <br />The Building and Planning Coordinator reviewed the <br />Planning Commission report and recommendations relative <br />to the building permit. <br />Mayor Bromander asked whether the applicant intended to <br />construct a restaurant without a liquor license. <br />John Welsch stated that he did. <br />Councilman Werdouschegg asked whether the building could <br />be relocated in such a fashion that parking would be <br />located further away from the abutting residential <br />property on the north. <br />The Building and Planning Coordinator stated it could; <br />however, he added that the affect of the lights from parking <br />would be less than the impact of the lights on the building <br />and that maintaining the building as shown in the lower <br />area on the site would be less obtrusive. <br />Councilman Werdouschegg asked whether berms were shown <br />on the site plan along 22A Street and 26th Avenue and <br />whether access could be provided through the parking lot of <br />the 7 -Eleven center. <br />The Building and Planning Coordinator responded that no <br />berms were shown on the site plan and that elevations <br />indicated that an access could be made but it might involve <br />the moving of certain of the parking spaces. <br />Mr Welsch stated that a hedge was contemplated along <br />26th Avenue and 22A Street. <br />Councilman Senden asked the applicant to clarify whether or not <br />he would build without a liquor license. Mr. Welsch reiterated <br />that he did intend to build the restaurant whether or not he <br />received a liquor license.
