1 <br />Council Proceedings <br />City of New Brighton <br />Oct. 12, 1976 <br />Mayor Bromander added that the variance was for property <br />that backed on County Ditch 2 and it had grade problems <br />on 7th Street. <br />Motion by Hardt, seconded by Fisher to close hearing. <br />5 ayes - 0 nayes- carried <br />Motion by Senden to approve variance subject to the <br />variance not exceeding 5 feet with a minimum of 10 feet <br />sideyard setback and subject to the garage not <br />exceeding 22 feet in width. <br />Motion failed for lack of a second. <br />Motion by Hardt, seconded by Fisher to direct <br />administration to prepare a resolution denying <br />VN -163 based on the following findings of fact: <br />4,j�_ 4 <br />1. That undue hardship has not been shown because <br />a one -car garage can be built on premises. <br />2. Unique circumstances have not been shown since <br />this situation could happen elsewhere within the City. <br />3. Unique circumstances applying to this property <br />have not been shown. <br />3 ayes - 2 nayes (Werdouschegg, Senden) - carried <br />Motion by Werdouschegg to approve a variance for a <br />14 foot sideyard setback to allow construction of a <br />garage accessing to 7th Street. <br />Motion failed for lack of a second. <br />Attorney stated the hearing was properly called. <br />The Planner reviewed the planning report and <br />Planning Commission recommendations. <br />Mr. Jack Bell,attorney representing the applicant, <br />reviewed the requested variance. He stated the change <br />in the operation of the station to self-service <br />operation required unique signing. He mentioned that <br />one of the two fuel price signs discussed in the <br />planning report had been removed. He noted that many <br />signs along Old Highway 8 were not properly setback. <br />He noted removal of billboards would not improve <br />the appearance of the property as they acted as a <br />screening device to property west of the subject <br />property. <br />Close <br />Hearing <br />VN -164 <br />9:41 to <br />10:28 <br />
