1 Council Proceedings City of New Brighton Oct. 12, 1976 Mayor Bromander added that the variance was for property that backed on County Ditch 2 and it had grade problems on 7th Street. Motion by Hardt, seconded by Fisher to close hearing. 5 ayes - 0 nayes- carried Motion by Senden to approve variance subject to the variance not exceeding 5 feet with a minimum of 10 feet sideyard setback and subject to the garage not exceeding 22 feet in width. Motion failed for lack of a second. Motion by Hardt, seconded by Fisher to direct administration to prepare a resolution denying VN -163 based on the following findings of fact: 4,j�_ 4 1. That undue hardship has not been shown because a one -car garage can be built on premises. 2. Unique circumstances have not been shown since this situation could happen elsewhere within the City. 3. Unique circumstances applying to this property have not been shown. 3 ayes - 2 nayes (Werdouschegg, Senden) - carried Motion by Werdouschegg to approve a variance for a 14 foot sideyard setback to allow construction of a garage accessing to 7th Street. Motion failed for lack of a second. Attorney stated the hearing was properly called. The Planner reviewed the planning report and Planning Commission recommendations. Mr. Jack Bell,attorney representing the applicant, reviewed the requested variance. He stated the change in the operation of the station to self-service operation required unique signing. He mentioned that one of the two fuel price signs discussed in the planning report had been removed. He noted that many signs along Old Highway 8 were not properly setback.
