Council Proceedings <br />City of New Brighton <br />Oct. 12, 1976 <br />Motion by Senden, seconded by Werdouschegg to approve <br />preliminary plat PL -105 subject to flowage <br />easements being provided by Super Valu to RCE Corporation <br />and the City of New Brighton in recordable form acceptable to <br />the City Attorney and subject to the preliminary plans <br />signed and dated by Arthur Ostlund, October 12, 1976 <br />5 ayes - 0 nayes - carried <br />Motion by Werdouschegg, seconded by Hardt to approve final <br />plat PL -105 subject to flowage easements being provided by <br />Super Valu to RCE Corporation and the City of New Brighton <br />in recordable form acceptable to the City Attorney and <br />to direct the City Clerk to not sign said final plat until <br />the easement document has been received, reviewed and <br />approved by the City Attorney. <br />5 ayes - 0 nayes- carried <br />0 <br />Motion by Bromander, seconded by Werdouschegg to direct <br />administration to prepare a resolution approving <br />VN -159 making the following findings of fact: <br />That this is a variance for a unique use which had not been <br />legislatively contemplated and the variance does not <br />offer special privilege because of the unified access and <br />egress to several properties and the variance is in the <br />interest.of the public health, safety and general welfare; <br />and to further condition the variance on the following <br />conditions being met: <br />1. That the site plan, reflect and proper documents be <br />presented granting access easements from the westerly <br />33 foot driveway on Mississippi Street to the <br />Brighton Veterinarian Clinic west of the driveway and the <br />vacant parcel east of the driveway; <br />2. That the site plan reflect and proper documents be <br />presented granting access easements from the Super <br />Valu property to the south and west sides of the <br />DX property; <br />3. That a proper reciprocal parking agreement between <br />RCE Corporation and Super Valu be presented; <br />4. That the site plan reflect and proper documents <br />be presented guaranteeing the closing of the westerly <br />Super Valu driveway on Mississippi Street and the <br />southerly Super Valu driveway on Silver Lake Road; <br />E'? <br />
