r <br />lower than than the middle pond an overflow line would be counter <br />productive as it would tend to increase the level of the south pond. <br />For this reason no control device for this. pond has been shown. For <br />the same reason, the area contributing flow to this pond could not be <br />considered as a part of the assessable area for the project to be <br />discussed later. <br />Middle & North Pond <br />The middle pond has varied in elevation from 911.5 (current) to <br />917 (1975). In 1970 at the time the 29th Avenue storm, sewer was <br />constructed, the pond was at 913.5. When the-pond reaches 914 walking <br />access from the north is cut off or people are forced to walk on the <br />rear of Lot 24. At 917 virtually all access is cut off. Again, the <br />slopes are steep and it would appear the potential ,for damage of <br />structures is remote. It would appear that if water ever reached 920 <br />it would flow through the common area to Rice Creek Road across Lots 23 <br />and 24 of Block 3. It is noted that there is a ditch between the <br />middle and north pond permitting drainage from south to north. <br />There would appear to be three primary options to alleviate the access <br />problem, with two of those options controlling water elevation. Those <br />options are: <br />1. Construct Outlet at 915 <br />This would maintain the level of the middle and north <br />pond at 915. Because access on common property is cut off <br />at 914, the area between the middle pond and Lot 24 would have <br />to be filled above the 915 level and the storm sewer from <br />29th Avenue would have to be e xtended approximately 20 feet. <br />In order to have adequate cover over the storm sewer, the walk- <br />way should be at the 918 level. This option is the one which <br />is shown in the engineering report. <br />This option preserves both ponds, protects adjacent <br />property, and allows the middle pond to exist at an <br />aesthetically attractive level. <br />We do not believe the fill work for the walkway easement <br />is assessable. The improvement would be for private purposes <br />totally, and would seem to have no public benefit. For this <br />reason the cost of the filling has not been included in the <br />project cost. Such work would have to be conducted by the <br />Homes Association. The estimated cost of fill and extending <br />the 29th Avenue storm sewer 20 feet is $2,000. <br />2 <br />
