Approved <br />• PLANNING COMMISSION PROCEEDINGS <br />CITY OF NEW BRIGHTON <br />Regular Meeting — April 15, 2008 at 7:00 p.m. <br />Present: Commissioners Larry Baker, Steve Danger, Bruce Howard, Tom O'Keefe and <br />Paul Zisla. <br />Absent: Jim O'Brien and Norm Schiferl. <br />Also Present: David Phillips, Council Member, Janice Gundlach, City Planner and Jason West, <br />Assistant Park and Recreation Director. <br />Agenda Review: Agenda was approved. <br />Minutes: Minutes for March 18, 2008 were approved. <br />Council Action: Council Member Phillips stated the Council would be reviewing the <br />applications for the Northwest Quadrant Task Force and the agenda for the Town Hall Meeting <br />at their next Work Session. He added at the May 13`h meeting the Council would be reviewing a <br />policy regarding cell towers in City parks. <br />Public Hearings: ZA2008-002 Zoning Code Amendment Impacting Section 11-020 (10) <br />Regarding Drive-Thru Facilities as Special Uses <br />• The City requests consideration of a Zoning Code Amendment impacting Section 11-020 (10) <br />regarding drive-thru facilities. This request arose following submission of a Site Plan application <br />for property located at 2051 Silver Lake Road, known as the Hollywood Video site. <br />Section 11-020 (10) provides for several stacking lane requirements for drive-in or drive -up <br />facilities. However, these requirements do not address impacts of a drive-thru to adjacent and/or <br />nearby uses or other issues than may have unintended negative impacts. During the course of <br />review of a Site Plan application for property at 2051 Silver Lake Road, it became apparent that <br />Section 11-020 (10) is not sufficient in terms of legally placing conditions on drive-thru <br />facilities. As such, staff suggested preparation of this amendment that would allow a drive-thru <br />by issuance of a Special Use Permit and would legally allow conditions to be imposed on use of <br />the drive-thru. <br />Baker suggested that the proposed requirement of "six stacking lanes" should be changed to <br />allow for more flexibility for the type of use. Gundlach replied that the language could be <br />changed to allow for more flexibility. Howard inquired how this proposal would affect existing <br />drive-thrus in the City. Gundlach replied that this amendment would not impact existing drive- <br />thrus, unless they decided to expand their drive-thrus. Howard and O'Keefe agreed with Baker <br />that flexibility should be required for different types of businesses. <br />O'Keefe questioned if there should be a requirement for a drive-thru to not negatively impact the <br />• driving pattern of the parking lot. Gundlach replied the applications go before the Public Safety <br />Commission and these applications should be reviewed on a case by case basis. With this <br />application they saw no negative impacts. <br />Motion by Baker, second by O'Keefe to CLOSE THE PUBLIC HEARING. <br />
