<br />I <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />December 8, 1981 <br /> <br />The city Council discussed the gambling <br />ordinance including the fee structure <br />proposed, the duration and fees for <br />temporary licenses, and variations in <br />fee structure for raffles and for fees <br />relating to tip boards, pull tabs, <br />padd1ewhee1s, etc. <br /> <br />Mr. Bob Finnerty was present and stated that <br />he was a lobbyist to the State Legislature and <br />that it was not the intent of the Legislature <br />to prohibit organizations from operating <br />if they do not own their particular building <br />or do not use a lease the entire 12 month <br />period. <br /> <br />Motion by Janecek, seconded by Schmidt to <br />refer the proposed ordinance regarding gambling <br />to staff for further study including consideration <br />of fee structures as proposed in Section 5-133, <br />interpretation of leased premises as in Section <br />5-138 and for study regarding Section 5-134(0) <br />on the regulation on the use of gambling proceeds. <br />5 ayes - 0 nayes - motion carried <br /> <br />Motion by Blomquist, seconded by Schmidt to <br />waive the reading, adopt and order publication <br />of an ORDINANCE AMENDING THE NEW BRIGHTON <br />ZONING ORDINANCE BY REZONING CERTAIN PROPERTY <br />OF THE CITY OF NEW BRIGHTON WITHIN "GROUP II" <br />OF THE COMPREHENSIVE REZONINGS (Generally <br />located north of 1-694, east of Long Lake, <br />west of 1-35W and south of the Mounds View/ <br />New Brighton border}. <br />5 ayes - 0 nayes - motion carried <br /> <br />The applicant was not present. <br /> <br />No one spoke to the application for special <br />use permi t . <br /> <br />The City Planner stated the application had <br />been in process for several months and that <br />the staff concern was essentially a health/safety <br />issue and that for that reason staff could not <br />support continuing the discussion of this item <br />until the summer of 1982. <br /> <br />Motion by Senden, seconded by Blomquist to <br />waive the reading and adopt a RESOLUTION MAKING <br />FINDINGS OF FACT AND DENYING APPLICATION FOR <br />SPECIAL USE PERMIT, SP-99. <br />5 ayes - 0 nayes - motion carried <br /> <br />-4- <br /> <br />Group II <br />Comprehensive <br />Rezonings <br />Supplement to <br />Report No. 81-254 <br />ORDINANCE #486 <br /> <br />SP-99, Boudreau <br />Report No. 81-261 <br />RESOLUTION #2536 <br />
