<br />I <br /> <br />I <br /> <br />I <br /> <br />........ r <br /> <br />, "'" ....,...., r' <br /> <br />>,.~..!~ <br /> <br />,"!'"' ....~!!!'!"'~. ~-"--....".''''.." .' <br /> <br />-;';,~i <br /> <br />City of New Brighton <br />August 24, 1982 <br /> <br />The City Council questioned and discussed procedures <br />for reviewing these projects and similar projects <br />by the City noting that in some cases the City's <br />Environmental Quality Commission has reviewed and <br />commented on the projects whereas in this case there <br />has been no previous EQC review. <br /> <br />Mr. Robert Nixon, owner of property on the east side <br />of Jones Lake, stated that he was opposed to the Jones <br />Lake project as the proposed weir would flood his <br />farm land area. Mr. Nixon stated that the water <br />quality will not be improved by this project and the <br />only result will be to hold back the water from <br />rushing through the ditch to Hanson Park. <br /> <br />Mr. weidenbacher noted that the proposed project will <br />not impact the larger storm but really only effect <br />water levels for the smaller storm. <br /> <br />Mr. Nixon stated that he is currently paying taxes on <br />9.98 acres and that the project would impact negatively <br />on his farming operation. <br /> <br />Councilmember Benke questioned who actually determined <br />the ordinary high water mark and whether the Watershed <br />District has the right to pond water on Mr. Nixon's <br />farm land. <br /> <br />Mr. Weidenbacher noted that the ordinary high water <br />mark was determined, as by law, by the State Department <br />of Natural Resources (DNR) and that the public has the <br />right to use all lands within the public waterbed. Mr. <br />Weidenbacher noted that Mr. Nixon is currently farming <br />within the public waterway but that that was acceptable <br />to the DNR. <br /> <br />Mayor Harcus stated that he did not see the benefit to <br />all property owners in regard to the Jones Lake improvement <br />and that he had no feeling either way for the other projects <br />proposed for New Brighton. <br /> <br />Councilmember Blomquist stated that he felt that the <br />Jones Lake project was very worthwhile and that he <br />was more concerned with the ditch improvement project <br />at the southwest quadrant of 1-694 and 3SW. Councilmember <br />Blomquist stated that his concern for the ditch improvement <br />project was that the property was within the City's <br />downtown redevelopment area and that he was concerned <br />for the future development of that property. Councilmember <br />Blomquist encouraged the Watershed District to discuss the <br />project with the current property owner to determine his <br />desires and thoughts as to future development. <br /> <br />-6- <br />
