(1) No final plan shall be received or considered unless it is based on an approved preliminary <br /> plan. <br /> The proposed sign utilizes the site plan that was approved with both the preliminary and final <br /> PRD. The actual location of the sign on the approval Site Plan is to the immediate north of the <br /> Long Lake Road access point (that is shared with the Christian Science Church). The PRD <br /> regulations do not provide separate sign regulation. However, if the Clifton House is considered <br /> a institutional use, Chapter 9 of the Zoning Code would allow for a 32 SF ground sign, not to <br /> exceed 10' in height and setback 10'from the right of way line. The proposed sign along Long <br /> Lake Road is compliant with these standards. <br /> (2) The Planning Commission shall review the final plan at its first regularly scheduled meeting <br /> occurring fourteen days after filing the application for final approval. <br /> The applicant submitted a request for a PRD amendment on December 31, 2008. The item was <br /> then placed on the first available Planning Commission meeting of January 20, 2009. <br /> (3) The final plan for planned residential development shall be in substantial compliance with the <br /> preliminary plan. <br /> Stafffinds that the proposed sign remains in compliance with the approved plans. <br /> (4) Substantial compliance shall mean any plan that: <br /> A. Has not increased its residential density. <br /> The proposed sign does not impact density. <br /> B. Has not enlarged its nonresidential floor area. <br /> Floor area is not impacted by the proposed sign. <br /> C. Has not decreased the area of the open space or changed the design of it so as to <br /> inhibit its original intent and design. <br /> The proposed sign encompasses 16 SF of ground space that was previously left as green <br /> space. The design of the green area is not impacted by the proposed sign. <br /> D. Has complied with the conditions or amendments placed on the preliminary plan by <br /> the City Council. <br /> The project is currently under construction and staff has been monitoring the site's <br /> development to ensure it is being constructed in accordance with approved plans. The <br /> Clifton House has met all conditions of approval. <br /> (5) The Planning Commission shall determine whether the final plat is in compliance with the <br /> provisions for filing a plan according to Chapter 26 of the City Code and shall list all variations <br /> or modifications from Chapter 26 in accordance with Section 7-060 (10) and(15). <br />
