Surrounding Land Uses: <br /> North: Rice Creek, parkland, single family homes <br /> South: Mississippi ST, office, single family homes <br /> East: parkland, single family homes <br /> West: Silver Lake RD, commercial <br /> SITE HISTORY <br /> This site at 2400 Mississippi Street (also known as Well House 12 & Creekview Park) has a <br /> history with regard to telecommunication towers/antenna. Below is a bulleted list of two <br /> pertinent approvals: <br /> • US West Wireless, LLC requested and was granted approval of a Special Use Permit on May <br /> 23, 2000 to allow three antennas/panels to be mounted on a 60' pole. The City agreed to <br /> remove the existing 41' emergency siren pole to allow for the 60' pole. The emergency siren <br /> was then remounted on the top of the new 60' pole with the cellular antennas mounted <br /> below. This request was looked upon favorably as a larger area would be covered by the <br /> emergency siren without any costs to the City. This pole w/emergency siren remains at the <br /> site today, however the cellular antenna have been removed. If this proposal were approved, <br /> the emergency siren would be moved to the new pole and this pole would be removed. <br /> • T-Mobile requested and was granted approval of a Special Use Permit on June 22, 2004 to <br /> allow construction of a 65' monopole w/cellular antenna. Included with this request was <br /> allowance of 2, 6' tall ground cabinets and 2, 4' tall ground cabinets to house equipment. <br /> This request encountered some resistance by the neighborhood, however the City ultimately <br /> approved the special use. The City's approval centered on two facts: 1) there is an existing <br /> 60' tower on site, and 2) the city didn't want to appear to discriminate against cellular <br /> carriers. Also, findings of fact were documented that all special use criteria had been met. <br /> SPECIAL USE PERMIT ANALYSIS <br /> The Special Use Permit includes construction of a 61' monopole accommodating six panel <br /> antennas and construction of a 12' x 20' equipment shelter. Any recommendation to approve <br /> such request would include removal of the existing 60' emergency siren tower and relocating the <br /> emergency siren to the top of the proposed 61' monopole. This site currently contains one active <br /> telecommunications pole located approximately 25' to the south of the proposed pole location. <br /> Lastly, well house # 12 is located on site to the immediate southeast of the proposed pole and <br /> equipment shelter location. Access to the pole and equipment shelter would be from the existing <br /> driveway on site. <br /> Zoning Code Section 4-600 (2) and (4) establishes a number of criteria that telecommunication <br /> towers and antenna must adhere to. A review of these criteria against the applicant's proposal is <br /> as follows (staff responses in italics): <br /> Section 4-600 (2) Building Permits Required. Building permits are required for towers and <br /> antennae. Such structures shall meet the regulations specified in this Subsection. <br /> a. All towers and antennae shall have setbacks equal to or greater than the height of the <br /> proposed structure. <br />
