<br />I <br /> <br />I <br /> <br />I <br /> <br />City of New Brighton <br />September 23, 1980 <br /> <br />Mr. 'I'om Oswalt, l41l 7th Street NW, homeowner I <br />reviewed the history concerning the granting <br />of the original house permit in 1959 and <br />the eventual construction of the culvert <br />and dam at the north end of Hansen Park. <br />Mr. Oswalt stated he felt the City at least <br />had a moral obligation to help him out. <br />Mr. Oswalt f~rther stated that he wanted <br />the City to purchase his property at fair <br />market value. Lastly, Mr. Oswalt stated <br />that it was his contention that the problems <br />with his home and yard is a result of the <br />construction of the dam which has had the <br />effect of decreasing the bearing potential <br />of his subsurface soils. <br /> <br />Ms. Virginia Ekloa, attorney representing <br />Mr. Oswalt, addressed the Council and reviewed <br />her clients options regarding this problem. <br /> <br />Motion by Janecek, seconded by Blomquist to <br />close the hearing. <br />S ayes - 0 nayes - motion carried <br /> <br />Motion by Blomquist, seconded by Janecek to <br />waive the reading and adopt a RESOLUTION MAKING <br />FINDINGS OF FAC'l' AND ORDERING THE REPAIR OR <br />REMOVAL OF A UNSAFE AND HAZARDOUS BUILDING. <br />5 ayes - 0 nayes - motion carried <br /> <br />Motion by Blomquist, seconded by Benke that <br />the matter of the Oswalt house be referred <br />to the staff to investigate and negotiate <br />a course of action to include engineering <br />studies to be taken by Mr. Oswalt and the City <br />and report to the Council the findings and <br />reconunendations. <br />S ayes - 0 nayes - motion carried <br /> <br />The Mayor declared a recess at 9:10 p.m. <br />Council reconvened at 9:25 p.m. <br /> <br />Council Business <br />Maurie Anderson, Director of Parks and <br />Recreation, described the proposed park <br />renovation plan. <br /> <br />The Mayor questioned if and where the <br />tot football field would be.
