A,�pr©ved <br />stated that he has talked with staff regarding a declaration that would give the City the right to enforce the <br />landscaping maintenance standards. <br />Mayor Larson stated that a privacy fence could be added to the berm and the patio to shield all property <br />owners at the west and it would solve most of the neighbor's complaints. Zisla questioned blocking the <br />view for the residents of Brightondale. Mayor Larson replied that a fence would address the neighbor's <br />issues and is a quick, easy fix. <br />Mike Gould, President of Silver Crest Properties, stated that they want to be good neighbors and are <br />committed to maintaining the property. O'Keefe asked if they would consider a privacy fence. Gould <br />stated that they would consider it. Danger asked Gould about the past maintenance of the landscaping and <br />how they would improve the relationship with the neighbors to increase the trust that it would be <br />maintained. He also questioned how the city would enforce the maintenance. Gould stated that PRD <br />would force them to maintain the property. Danger asked if they would allow the landscape architect to <br />work with the neighbors. Gould stated that they are willing to work with the neighbors to reach a solution <br />everyone is happy with, but they are not willing to hire a landscaper to work the neighbors. Howard asked <br />if they are willing to move the two remaining mechanical units. Gould replied that by eliminating the <br />nosiest machines and replacing the remaining two units with more efficient machines make the move to <br />the east side unnecessary. <br />Jeff Westner, NLK Land Architects, stated that there are several swells on the property that cannot be <br />planted in, and they also prevent the planting of large trees. Upon review of the site it was determined that <br />a spade could not be brought onto the property because of the existing mature trees and buried utility lines. <br />Motion by Baker, seconded by O'Keefe to close the public hearing. <br />No vote was taken on the motion, as Schiferl suggested leaving the hearing open to address the existing issues. <br />Gould presented the information received from their sound consultants. Phillips stated that the <br />information should have included background noise, which it currently does not. Olson asked if the <br />window air conditioners were also included. Gould replied that when this test was completed only two <br />units were running. Baker asked where the sound wall would be placed. Gould showed the <br />Commissioners on a map where the wall would be placed, just west of the unit. <br />Doug Johnson, 2025 28th Ave NW, opposes the project due to noise from window air conditioners and poor <br />landscaping. <br />Baker stated that the addition does not impose on the existing green space; the applicants have addressed <br />the mechanical noise issues, and have proposed an improvement to the landscaping. O'Keefe generally <br />agrees with Commissioner Baker, and favors writing in the maintenance of the landscaping into the PRD. <br />Danger stated that he is hoping that the two sides can compromise to achieve a satisfactory agreement. <br />Zisla stated that maintenance is an issue and noise is currently a problem, but he believes that the noise <br />issue would be improved with this plan. He also believes that an improved landscape plan must be <br />presented before it goes to Council, with some sort of enforcement added. Howard stated that this is an <br />opportunity to improve the inside and outside of the property and agrees with Commissioner Baker's <br />.statements. He also believes that enforcement needs to be added. Schiferl stated he would like to table <br />the meeting for a month to see if the landscaping and noise issues could be addressed. Phillips stated that <br />he would like to have the Commissions recommendations in a form of a motion to move the application <br />forward. Olson stated that the neighbors have never been asked what may work best for the area and <br />would like to have their view point taken into consideration. <br />
