Appr6ved <br />Motion by Zisla, second by Danger to RECOMMEND THE CITY COUNCIL REAPPROVE THE AMENDED <br />REQUEST CONSISTENT WITH RESOLUTIONS 07-031 AND 08-055, INCLUDING THE FOLLOWING <br />CONDITIONS OF APPROVAL: <br />1. The exterior sound system shall not be part of the restaurant's overall audio entertainment <br />system. <br />2. Audio on the outdoor dining patio shall be limited to background music. <br />2. Any future plan to and an awing or roof over the outdoor dining patio shall come back for Site <br />Plan consideration. <br />5 ayes, 0 nays. MOTION APPROVED. <br />Public Hearing: SP2009-006 Special Use Permit to permit Installation of Telecommunications <br />Equipment on the Water Tower at 6605th ST SW <br />The applicant works for Buell Consulting and is acting on behalf of Clearwire Communications. The <br />Special Use Permit request would allow for construction of three panel antennas and three microwave <br />dishes on the water tower at a height of 100'. Also included in the request is the ability to lease a 10' x <br />10' ground space area within the water tower to place the necessary equipment to operate the antennas. <br />The antennas would be painted to match the water tower and expected installation would be the summer <br />of 2010. <br />The applicant has been working with City staff regarding numerous potential Clearwire sites within the <br />New Brighton municipal boundary. City staff has been advised that Clearwire is hoping to secure 300 — <br />500 sites within the metropolitan area to provide 4G wireless high speed internet services to consumers <br />and businesses. This request is one of four sites Clearwire is considering in New Brighton. <br />Schiferl asked staff if there is any chance that the Public Works Director could ask the tenant remove their <br />equipment from the interior of the water tower. Gundlach replied that Public Works Director has no <br />problem with having the equipment inside the water tower; his only concern was that the proposed <br />location of the equipment was too close to the door and would also like to ensure there is room for future <br />users' equipment. Schiferl asked if there is still room to co -locate additional carriers on the water tower. <br />Gundlach replied that all the current carriers are located on this tower, but there is room for additional <br />equipment if other carriers/providers enter this market. <br />Schiferl asked if the Council has addressed the issue of cell towers in parks. Phillips replied there is not a <br />policy regarding parks, but have given the indication that they would discourage it. Phillips asked if the <br />applicant should have the ability to seek a Conditional Use Permit without having a lease agreement with <br />the property owner. Gundlach replied that the Conditional Use Permit can not be acted upon unless the <br />applicant receives a lease agreement from the property owner, which in this case is the City. It is the <br />intent that the lease agreement will be before the Council at the same time as this Conditional Use Permit. <br />Schiferl asked the applicant to list the other locations they are considering for their antennas. Rob Viera, <br />Buell Consulting, replied that they are considering Creekview Park, Freedom Park, and an existing Xcel <br />Energy electrical transmission tower.
