• PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — August 17, 2010 7:00 p.m. <br />Present: Commissioners Bruce Howard, James Alvey, Verne McPherson, Steve Danger, Paul Zisla <br />Norm Schiferl and Erin Nichols-Matkaiti <br />Absent: None <br />Also Present: David Phillips-Councilmember„ Janice Gundlach-City Planner, and Katie Bruno -Office <br />Assistant. <br />Agenda Review: No Changes. <br />Minutes: Minutes from July 20, 2010 were presented and approved. <br />Council Action: Councilmember Phillips reported the Council has been working on the budget most of <br />the year, and will be submitting a 0% levy increase for 2011. The total budget will be reduced by <br />$200,000, and $1.1 million will be transferred to the Fleet -Non -Fleet account from the Fund Balance <br />account. <br />•Public Hearing: <br />(A) Larry Zipkin on behalf of Champp's Restaurant, 2397 Palmer Drive, requests an <br />amendment to a previously approved Special Use Permit that allowed for outdoor dining, <br />to allow omission of wrought iron decorative gating on top of the patio wall. <br />City Planner Gundlach reported the applicant is requesting an amendment to a Special Use Permit <br />approved on October 27, 2009 that allowed for construction of an outdoor dining patio. The applicant is <br />requesting permission to exclude the ornamental railing that was to be constructed on the top of the patio <br />wall. The outdoor dining patio is fully constructed with the exception of the railing element. The <br />applicant has been given permission to occupy the patio, however a cash escrow of $3,200 is being held <br />pending the outcome of this request. The escrow will be returned when: A) the Council approves this <br />amendment request, or B) the railings are installed. Twenty eight notices were sent out to nearby <br />properties, no inquiries were received. Staff recommends denial of the requested Special Use Permit <br />amendment to eliminate the ornamental railing on top of the patio wall. Staff would further recommend <br />that the applicant be advised to keep a railing feature but authorize use of a material other than the <br />proposed iron should the applicant wish to reduce costs. <br />Commissioner Schiferl questioned if the decorative railing was intended to screen the patrons or the <br />general public? Ms. Gundlach replied the original intent of the railing in unknown, as screening could <br />provide a benefit to both the patrons and the public. <br />Commissioner Zisla questioned if the planned fire pit will be included? Ms. Gundlach reported proper <br />connections were not installed during construction. Councilmember Phillips questioned the height of the <br />patio; it was reported as 4 feet, with an additional 12-18 inched to the top of the pillars. <br />Wayne Beliel representing Champps introduced himself as the sole owner of the business. Mr. Beliel <br />• reported he had experienced trouble with his contractor, including a completion date three months later <br />than anticipated. Mr. Beliel reported the fire pit will be installed within a few weeks. <br />
