Mr. Beliel <br />responded he is rather indifferent of the railing, and has not received any negative comments or concerns <br />with the absence of the railing. Commissioner Schiferl suggested putting planter boxes on the open <br />areas. <br />Motion by Commissioner Zisla, seconded by Commissioner Schiferl to close the Public Hearing. <br />7-0 Motion carried <br />Motion by Commissioner Zisla, seconded by Commissioner Schiferl to recommend approval of the <br />resolution allowing the amendment. <br />Commissioner Danger commented he likes the idea of planter boxes, while he doesn't see a need for any <br />additional screening. Commissioner Nichols Matkaiti suggested a possible distraction could occur for <br />the traffic if there was ever an incident on the patio. Commissioner Alvey stated the open spaces could <br />pose a safety hazard to a child who may attempt to climb the fence. <br />City Planner Gundlach recommended adding the following condition: <br />The applicant is permitted, at a future date, to implement a decorative railing option on top of the outdoor <br />• dining patio wall without having to obtain approval of an additional amendment to SP2009-007. <br />7-0 Motion carried. <br />(B) Rob Viera on behalf of Clear -wire Legacy LLC requests a Special Use Permit to permit <br />erection of panel and directional antennas on top of the existing Xcel Energy electrical <br />transmission tower, at a height of approximately 140', located at 1950 Old Highway 8 <br />NW. <br />City Planner Gundlach explained the Special Use Permit request would allow for installation of up to <br />nine antennas, consisting of a combination of panel and dish style, on the existing Xcel Energy <br />Transmission Tower at 1950 Old Highway 8 NW at a height of 140'. Because the type of number of <br />antennas is related to the types and numbers of other antennas within the Clearwire grid, the applicant is <br />requesting flexibility to determine at a later date the actual number and type needed for this location. The <br />applicant worked with City staff in late 2009 on numerous other Clearwire sites within the New Brighton <br />municipal boundary. At that time, the applicant was working with Xcel Energy on a site farther north on <br />Old Highway 8 NW (2172 Old Highway 8 NW) but that site is no longer available from Xcel Energy. <br />The applicant has obtained landowner consent for the ground space needed at this location and is <br />currently working with Xcel Energy on signing a Master Lease Agreement that would allow Clearwire to <br />install equipment on many Xcel Energy -owned poles/towers Staff finds all special use standards of <br />Section 4-600 (2) & (4) and Section 8-130 to be met. The applicant notes a late 2010/early 2011 <br />installation for the antennas. <br />
