October 12 , 2010 Page 4 of 7 <br />Councilmember Bauman questioned the number of residents that want to continue; Director Wyffels <br />reported he recieved two calls from people not wanting to continue the process. <br />Jack Hale, 2154 Bicentennial Ct. reported early in 2000 the neighbors were excited about the positive <br />changes that were planned or the pond. The project failed, and the residents are feeling disappointed. Mr. <br />Hale questioned the findings of a pond survey conducted in the spring of 2010. Director Wyffels reported <br />the City has been surveying various ponds throughout the City, about 5 annually. City staff has not yet <br />had adequate time to analyze the survey. Director Wyffels stated the City does intend to maintain the <br />pond as part of its Stormwater Management Plan. <br />Mayor Jacobsen asked for additional comments; there were none. <br />Motion by Councilmember Burg, seconded by Councilmember Phillips to close the Public Hearing. <br />5 Ayes, 0 Nays, Motion Carried <br />The Public Hearing was closed at 7:15 pm. <br />Councilmember Burg questioned if other options have been explored, such as a bubbler system. Director <br />Wyffels responded that would be an option that could be explored in the future with the taxing district. <br />Councilmember Phillips questioned if the district could be dissolved, and nothing more be done, would <br />that allow adequate time for a proposal to offer the proposed new district. Director Wyffels stated the <br />district could be dissolved, without defining a new district. Mr. Hale stated it would be preferred to <br />recommend a new taxing district once a pond management program is prepared. Councilmember Burg <br />suggested hiring an intern in hydrology to assist with the project. <br />Motion by Councilmember Phillips, seconded by Councilmember Bauman to dissolve the <br />Bicentennial Pond stormwater taxing district and direct staff to investigate alternatives and report <br />back by January 15, 2011. <br />4 Ayes, 0 Nays, 1 Abstention <br />Ayes: Mayor Jacobsen, Councilmembers Bauman, Phillips and Samuelson <br />Abstention: Councilmember Burg <br />Council Business <br />1. Renewal of Provisional Multi Family License for Silver Lake Flats. Report No. 10-236. <br />Officer Trevor Hamdorf rcported the following buildings were included in the license; 2090, 2100, 2130 and <br />2160 County Rd E. The ordinance was reviewed briefly, along with the requirements to be included in a <br />mitigation plan. Because the calls for service have not decreased over time, city staffhas requested changes be <br />made to the mitigation plan. The mitigation plan submitted by the applicant meets staffs requirements. <br />Councilmember Phillips clarified any call for service from a victim of domestic assault would not be considered <br />a provisional call; and wanted to assure victims the freedom to call of assistance; without fear of being evicted <br />Councilmember Bauman reported she was disappointed that the applicant was not in attendance, and reported <br />her fiusttation with the lack of improvement. Deputy Director Paebmick stated the council has the option not to <br />renew the license, resulting in the inability to rent any vacant units. City Attorney LeFevere explained if the <br />license was not renewed, and the applicant continued to rent, they could be criminally prosecuted for renting <br />without a license. LeFevere stated the if the applicant complies with the approved mitigation plan, they still <br />qualify for the provisional license. <br />Councilmember Burg requested information related to lease holders as well as vacancies. Officer Hamdorf has <br />been working with Northwest Youth and Family Services to get the youth involved as part of a solution; similar <br />to the approach taken at the Freedom Park Skate Park. <br />Councilmember Phillips suggested the following items be included in the mitigation plan; a list of occupied and <br />non -occupied units, and the applicant provide a play area in a safe location within six months. <br />
