I Approved Commissioner Danger asked if the applicant would typically do cremations after regular business hours. Mr. Wyland said it would be atypical, but the situation could arise. Mr. Kotoski asked when the first Special Use Permit was applied for. Ms. Gundlach stated prior to 2006, and was renewed in 2006. Jane Jorgenson requested the hours of operation are specified. Mr. Jorgenson requested the commission consider the concerns of the Arden Hills residents. Ms. Gundlach_stated the hours of operation for the surrounding industrial area for a permitted use is 24 hours a day-7 days a week. A specially permitted use can have hours of operation imposed. Paul Gruetzman, residing at 173 2nd Ave SE requested traffic be routed to 1st Street. Councilmember Bauman asked what the process is for unclaimed ashes. Mr. Wyland responded unclaimed ashes will be brought to a farm near Aitken, MN for burial within thirty days. Charlie Gantzer, Barr Engineering addressed the difference between stack temperature and flue temperature, noting toxic screening is not required for animal or human waste. Mr. Gantzer addressed the questions related to odor testing, stating there is a ASTM (American Society for testing materials) standard. Chairperson Howard questioned the reason the MPCA would not require a permit for emissions. Mr. Gantzer commented that crematories have controlled burns. Chairperson Howard checked with the residents to be sure their questions were addressed. Mr. Kotoski asked for clarification on Mr. Gantzer's comment stating he feels a permit would be required. Mr. Gantzer responded that was correct, based on stack height. City Planner Gundlach noted that the permit would be submitted to the City for review. City Planner Gundlach said she contacted the cities of Minneapolis, Minnetrista, Duluth and Brooklyn Park, all having crematories with residential areas adjacent, there were no complaints reported to any of the cities. Commissioner McPherson asked if the train is restricted in its hours of operation. Ms. Gundlach stated the train is regulated by the Federal Government and there are no restrictions. Commissioner McPherson suggested allowing at least one evening per week to be open. Also suggesting natural fencing as the preferred choice. Commissioner Danger noted the insulated pipes used for the stack are pre cut lengths, and difficult to cut. Commissioner Nichols-Matkaiti suggested including"one pet at a time" as part of the conditions. Chairperson Howard spoke to the Arden Hills residents, assuring them they would get the same attention as if they were New Brighton residents. Commissioner Howard noted three of the five conditions are clearly met and based on the staff report and testimony heard the other two standards are met as well. Commissioner Howard stated he understands that some residents are not comfortable with the use, noting that is not grounds for denial. Motion by Commissioner Alvey seconded by Commissioner McPherson to close the Public Hearing. 5 Ayes, 0 Nays, Public Hearing was closed at 8:41 pm.
