1 <br /> Approved <br /> Commissioner Danger stated the applicant has agreed to work with the neighbors to work out an <br /> agreeable plan. <br /> Commissioner Nichols-Matkaiti suggested being specific, while giving an opportunity to work out an <br /> agreed upon plan. <br /> City Planner Gundlach stated the requirements are a minimum, and any screening greater than the <br /> minimum would be accepted. <br /> Commissioner McPherson noted that currently there is no screening, and feels that it is reasonable to <br /> require screening as stated in the resolution. No changes were made to the condition. <br /> Condition 5) City Planner Gundlach suggested adding"cremate pets one at a time." <br /> Condition 9) City Planner Gundlach noted a typo, currently states "a height of the one inch" should be <br /> one foot. Also adding"the stack shall be located on the southern side of the pitched roof." <br /> Condition 11) Commissioner Danger stated he agrees with Commissioner McPherson allowing the <br /> applicant to be open for business two nights per week. Commissioner McPherson asked the applicant if <br /> they would like the ability to open earlier in the day than 9:00 am. Commissioner McPherson suggested <br /> Monday through Friday 8:00 am-6:00 pm, Saturday 9:00 am -12:00 pm, closed on Sundays. Also it was <br /> suggested to allow the applicant to remain open two evenings per week, while limiting the hours the <br /> retort can operate to 6:00 pm. Commissioner Nichols-Matkaiti suggested allowing hours of 9:00 am- <br /> 2:00 pm on Saturdays. <br /> Motion by Commissioner McPherson seconded by Commissioner Danger to approve amendments <br /> to conditions 5, 9, and 11. <br /> 5 Ayes, 0 Nays, Motion Carried <br /> (B) Pratt Ordway Properties requests a Planned Unit Development Amendment and <br /> Special Use Permit to allow construction of an outdoor dining area for the corner tenant of <br /> Building E, located at the northwest corner of 5th AVE NW and 5th ST NW (County Road <br /> E2 Extension) at 500 5th AVE NW. <br /> City Planner Gundlach reported the applicant is Pratt Ordway Properties, which owns and manages the <br /> Main Street Village development. The restaurant, Glory Days Bar& Grill, is acting as a co-applicant for <br /> the request. An amendment to the PUD is necessary as numerous PUD's have been approved over the <br /> years governing a phased development of Main Street Village. A Special Use Permit is required for all <br /> outdoor dining areas in the B-3 and B-4 zoning district. <br /> The request would allow construction of an outdoor dining patio for use by the corner tenant of Building <br /> E, which is located at the northwest corner of 5th Ave NW and 5th St NW (also known as County Road <br /> E2 Extension). As proposed, the patio would seat 64 persons. <br /> There are numerous PUD standards of Section 7-230 to be considered for a"major amendment". <br /> Staff reviewed these and found none of them are impacted by the proposal. Outdoor dining is consistent <br /> with the intent of the downtown business zoning district. With revisions to the patio, it will not <br /> negatively impact the development, circulation patterns,visual character, or drainage utilities. <br /> Conditions can be imposed to mitigate noise to the residential uses nearby. Existing screening is in place <br /> and will not be impacted. <br /> Also required is a finding that the special use standards of Section 8-130 are met. <br /> 5 <br />
