Approved <br /> Staff finds the special use standards are met based on the following: <br /> • Screening and noise conditions will ensure there will be no detrimental impact to the public <br /> health and safety. <br /> • This area is already fully developed with a mix of commercial, office, industrial, and residential <br /> uses consistent with a downtown environment. <br /> Other Applicable Standards <br /> • Staff finds the patio must be slightly revised to ensure it is outside of the right-of-way and doesn't <br /> impact site circulation and drainage facilities on site. No specific setback requirements exist in <br /> the B-4 district. <br /> • Section 6-390(3) requires screening of commercial uses adjacent to residential uses. Staff finds <br /> the existing mature trees provide adequate screening for the residential uses across 5th AVE NW. <br /> • Parking must be managed on-site through the existing shared parking arrangements. On street <br /> parking is prohibited on 5th AVE NW, ensuring parking will not overflow into residential <br /> 100 notices were sent out, there were no inquiries. Staff recommends approval with conditions. <br /> Chairperson Howard questioned the reason staff designed the revised plan. City Planner Gundlach <br /> clarified that the intent was to demonstrate the requirements, explaining the applicant will submit a <br /> revised plan at the time the building permit is applied for. <br /> Commissioner Nichols-Matkaiti asked if any additional lighting is proposed. The applicant responded <br /> any lighting would be low voltage. Commissioner McPherson questioned if there will be any access <br /> from the street side. Ms. Gundlach responded an (alarmed)Emergency Exit would likely be required. <br /> Commissioner Alvey asked if there would be limits on the hours of operation. City Planner Gundlach <br /> explained any disruptive noise issues, would likely be forwarded to Public Safety. The applicant will <br /> need to monitor that, as calls for service to the Public Safety Department will affect the applicant's liquor <br /> license application process. <br /> Chairperson Howard opened the Public Hearing at 9:11 pm. <br /> Marla Ordway, representing Pratt Ordway stated she is hopeful this project will help other tenants in the <br /> area. Pamela Lynn, representing Glory Days Bar commented that have had numerous requests for patio <br /> seating. <br /> Motion by Commissioner Danger seconded by Commissioner Alvey to close the Public Hearing. <br /> 5 Ayes, 0 Nays, Public Hearing was closed at 9:15 pm. <br /> Commissioner Danger commented that all the commissioners hope to see businesses succeed, and <br /> commented that the patio addition will be a benefit. <br /> Motion by Commissioner McPherson seconded by Commissioner Nichols-Matkaiti to approve staff <br /> recommendation; amending condition No. 1 removing the "as illustrated" clause. <br /> Commissioner Nichols-Matkaiti asked if this recommendation is consistent with the Champps request. <br /> Ms. Gundlach confirmed it is. <br /> 5 Ayes, 0 Nays, Motion Carried <br /> 6 <br />
