The estimated amount of LESSEE'S Operating Costs charge shall be paid in monthly installments in the <br /> amount of $85.00 beginning December 1, 1996. <br /> The term Operating Costs shall exclude: (a) cost of any work or service rendered exclusively for any <br /> tenant, and the installation or alteration to the Building which under generally accepted accounting <br /> principles are properly classified as capital expenditures; and (b) brokerage commissions, advertising fees <br /> or other costs in procuring tenants. income taxes on LESSOR, and depreciation on LESSOR; and (c) <br /> management or administrative fees exceeding 4% of gross rental receipts; and (d) cost of painting, <br /> repainting, decorating and redecorating for any tenant of the building; and (e) all expenses, attorney fees. <br /> costs of LESSOR arising out of compliance with ADA and/or in remediation of any hazardous waste <br /> problem. <br /> Within 90 days after the end of the Lease Year. and each anniversary thereof, the LESSOR shall deliver <br /> to LESSEE a statement setting forth the amount of Operating Costs for the Lease Year, and the amounts <br /> relative to the then current year, together with an invoice showing the amount of increase or decrease for <br /> reimbursement. Copies of accounting statements, along with the real estate tax receipt. shall be furnished <br /> to LESSEE upon request. LESSEE shall have the right, upon written notice to LESSOR, to audit the <br /> books. If LESSEE'S audit indicates LESSEE has been overcharged, then an appropriate refund shall be <br /> made to LESSEE. if said overcharge is over 5%. then LESSOR shall additionally pay for LESSEE'S <br /> audit. <br /> 11. HOURS OF OPERATION <br /> LESSEE'S hours of operation shall be 8:00 a.m. to 5:00 p.m., Monday through Friday. <br /> However, LESSEE'S employees are not required by this Lease to continuously occupy the <br /> Premises during the above days and hours due to the nature of LESSEE'S business operation, nor <br /> shall LESSEE be obligated to light the Premises or its signage beyond the hours set forth above. <br /> Additionally. LESSEE shall have 24 hour access to the Premises and the Common Areas. <br /> 12. PARKING <br /> LESSOR will provide LESSEE with 4 unallocated parking spaces. <br /> 13. SIGNAGE <br /> LESSOR will allow LESSEE to install signage on the building and/or property building standard <br /> signage to be located on the facade above the Premises and shall also be able to put LESSEE'S <br /> signage on a multi-tenant sign provided by LESSOR. LESSOR shall also be able to install signage <br /> to be located on the entry door of the Premises as per Exhibit S-7. LESSEE'S signage shall <br /> conform to all applicable local, city and county requirements. <br /> All signs shall be constructed, maintained and installed at LESSEE'S sole cost and expense and in <br /> a quality and workmanlike manner. Electrical connections, if applicable, shall comply with the <br /> latest National Electrical Code. All electrical wiring shall be enclosed in bu tiding standard <br /> raceway or wireway, if applicable. All electrical connections shall be wired to LESSEE'S panel <br /> and meter. <br /> LESSEE'S sign contractor shall be responsible to repair any damage caused by sign installation or <br /> • maintenance. LESSEE shall be responsible to remove its signs and repair any damage caused by <br /> said removal as soon as practical after any termination of this Lease. <br />
