Director of Public Works Wyffels commented that the contract between the City and <br />Shafer Contracting would assure that both parties were held to defined specifications. He understood the City <br />had an unfortunate experience with Shafer Contracting 20 years ago. He commented this company had a <br />great reputation and was one of the largest contractors in the metro area <br />Councilmeanber Burg understood Shafer was a large company but wanted to be assured the City was covered <br />and that no unwanted material would be brought onto the New Brighton Exchange site. <br />Councilmember Samuelson asked if additional bids were being sought for this work. Director of Public <br />Works Wyffels indicated through State Statute the City could spend $100,000 without needing to go out for <br />competitive bids. He noted a quote was taken from North Pine Aggregate. <br />Councilmember Samuelson requested further information on the previous lawsuit Councilmember Burg <br />discussed the matter in detail. <br />Mayor Jacobsen thanked Councilmember Burg for bringing this matter to the Council's attention. However, <br />he was pleased with staff s diligence on the matter and for the language provided in the proposed contract <br />He questioned if staff had any concerns on the matter. Director of Public Works Wyffels stated his only <br />concern was allowing Pulte Homes their due diligence on the New Brighton Exchange site, as it would now <br />be slightly altered Staffhas been in contact with Pulte Homes and they supported the concept <br />Councilmember Bauman asked if the City still needed another 100,000 cubic yards of soil material. Director <br />of Public Works Wyffels stated this was the case; more material would be needed in the future. At this time, <br />the most the City can spend on the item is $100,000. <br />Coundmember Bauman recommended the Class 7 credit be used to buy more material if available through <br />Shafer Contracting. Director of Public Works Wyffels indicated this would not be allowed after discussing <br />the matter further with the City Attorney. <br />Councilmember Jacobsen inquired how much Class 7 was located on the New Brighton Exchange site. <br />Director of Public Works Wyffels stated there was approximately 38,000 cubic yards of Class 7. <br />Councilmember Burg thanked staff workmg so diligently on this matter and for bringing the proposal to the <br />Council. <br />Motion by Councilmember Jacobsen seconded by Councilmember Sameulson to authorize City <br />Project 12-15, New Brighton Exchange Tract 2 Import Soil Project and authorize the Director of <br />Public Works to perform the following tasks related to this project: <br />1. Enter into a contract with Shafer Contracting to import, place and compact up to <br />100,000 cubic yards of import material in an amount not to exceed $1.00 per cubic <br />yard of soil material imported into the New Brighton Exchange site: <br />• Shafer will pay for and install all necessary erosion control items required <br />by the Rice Creek Watershed District. <br />• Shafer will pay for any related regulatory permitting costs associated with <br />this project. <br />• Shafer will pay 50% of all costs associated with required environmental <br />testing. <br />• Shafer will pay the City $1.00 per cubic yard (loose volume) of Class 7 <br />material hauled from the NBE site. They may purchase this material from <br />the City depending on if they are able to use it on the I-694/Highway 10 <br />reconstruction project in Arden Hills. It is estimated 30,000 cubic yards of <br />material could be sold to Shafer Contracting. <br />2. Authorize Barr Engineering to perform environmental testing on the soil material <br />to be imported into the NBE. Based on the work scheduled, the estimated cost to <br />complete this task is $25,000, which includes $18,000 in analytical costs. Shafer <br />has agreed to pay for half of these environmental costs. <br />3. Enter into a professional services agreement with American Engineering Testing, <br />Inc. (AET) for geotechnical and field screening services of the imported soil <br />material in amount not to exceed $18,750. <br />Page 5 of 6 <br />
