November 26,2012 Page 3 of 4 <br /> City Planner Gundlach indicated this site is located directly across the street from the approved <br /> school bus terminal of American Student Transportation at 401 1st Street SW. The bus <br /> terminal garnered much discussion based on the amount of traffic that would be produced by <br /> the site. The applicant was asked whether the proposed addition would produce additional <br /> truck traffic to the site. The property owner has indicated the proposed addition could result in <br /> two additional semi-truck trips per day, at the greatest. The Public Works Director has <br /> indicated this amount is negligible when compared to the amount of traffic on lst Street SW <br /> already and a traffic analysis/study would not be necessary. <br /> City Planner Gundlach explained the Zoning Code provides that three conditions be evaluated <br /> when considering approval of a Nonconforming Use Permit. Staff determined the criteria are <br /> met based on the fact the applicant has proof of parking concepts have been submitted <br /> illustrating the site can accommodate the code required amount of stalls needed, the building <br /> and parking setback nonconformities have minimal, if any impact as the encroachment in both <br /> cases is less than two feet; and it would not be practical to eliminate the building and parking <br /> setback nonconformities. Staff indicated the Planning Commission met on November 20th and <br /> unanimously recommended approval of the Site Plan and Nonconforming Use Permit, subject <br /> to the following conditions: <br /> 1. The proposed improvements are built in accordance with the plans provided. <br /> 2. Implementation of the recommendations contained in the interoffice <br /> Engineering/Public Works and Public Safety memos. <br /> 3. The applicant enters into a proof of parking declaration of covenants form to be <br /> satisfactory to the City Attorney prior to release of the building permit. <br /> 4. At the time of building permit, the applicant shall produce necessary Rice Creek <br /> Watershed District and MnDOT permits related to storm water management. <br /> Councilmember Bauman thanked City Planner Gundlach for the thorough staff report. She was pleased <br /> Wolkerstorfer was expanding their business. She questioned if the declaration of covenants would be applied <br /> to both present and future owners. City Planner Gundlach stated this was the case and the proof of parking <br /> would only be built if there was a concern in the future. <br /> Councilmember Burg was also pleased a company in New Brighton was expanding. <br /> Councilmember Jacobsen asked if there were any parking concerns at this time. City Planner Gundlach <br /> explained there were no parking issues with the site and there were no complaints for the property on file. <br /> Councilmember Samuelson questioned when construction of the addition would begin. Mr.Wolkerstorfer <br /> anticipated this would begin sometime in February of 2013. <br /> Commission Liaison <br /> Motion by Councilmember Burg,seconded by Councilmember Jacobsen to adopt a Resolution Reports, <br /> approving the requested Site Plan and Nonconforming Use Permit subject to the four conditions Announcements and <br /> Updates <br /> recommended by Staff <br /> 5 Ayes,0 Nays-Motion Carried <br /> Commission Liaison Reports,Announcements and Updates <br /> Dean Lotter <br /> City Manager Lotter reported he would be sending out an email to the Council regarding a <br /> potential meeting to be held in December between the Council and Pulte Homes. Pulte Homes <br /> was interested in purchasing a portion of New Brighton Exchange. He indicated API was <br /> interested in a parcel east of The View, which would be a completely separate issue. He then <br /> discussed the paperless packet options with the Council noting more information would be <br />
