SECTION 16 <br /> OTHER LEAVES <br /> 16.1 Eligibility Requirements <br /> Unless otherwise noted or required by law, employees shall be eligible for the <br /> leave provisions of this Section following the completion of their first six (6) <br /> months of employment. <br /> 16.2 Jury Duty <br /> Any regular full-time, three quarter time, and half time employee who is called <br /> upon to serve on a jury during scheduled work hours shall receive the amount of <br /> his/her regular salary minus the amount paid for services as a juror. An employee <br /> who is called for jury duty shall report for work any time that the court does not <br /> require his/her presence. Employees called for jury duty should notify their <br /> Department Director immediately and work with the Finance Department to <br /> coordinate payroll functions. While serving on a jury, employees will continue to <br /> maintain their current employee benefits. <br /> 16.3 Family Medical Leave Act-Employee and Employer Rights <br /> (Public Law 110-181) <br /> FMLA is intended to balance the demands of the workplace with the personal <br /> and medical needs of families and to promote the stability and economic security <br /> of families. It is intended to provide protections for employees as well as <br /> employers by providing up to twelve (12) weeks of unpaid, job protected leave for <br /> the birth of a child, adoption, foster care and certain individual and family medical <br /> reasons. The City of New Brighton will comply with the Family Medical Leave Act <br /> of 1993, (FMLA, Title 29, Part 825 of the Code of Federal Regulations) and all <br /> future revisions to the Act. <br /> 16.4 FMLA Employee and Employer Rights <br /> This FMLA leave policy is intended to be a general summary of the law. FMLA <br /> leave is governed by federal or state regulations. Those regulations shall control <br /> if they conflict with this policy. Each situation will be evaluated on a case-by-case <br /> basis, consistent with applicable law. Where provisions of the City personnel <br /> policies, contracts, or agreements, are in conflict with FMLA, those regulations <br /> which are most beneficial to the employee, shall apply. <br /> In order to be eligible for FMLA benefits, an employee must: <br /> • Have worked for the employer for a total of 12 months; and <br /> • Have worked at least 1,250 hours over the previous twelve (12) months <br /> 16 5 FM1 A Qualifying Even <br /> e , <br /> or physical or mental condition that involves inpatient care or continuing <br /> treatment by a health care provider 4hat req ores• <br />
