A serious health condition is an illness, injury, impairment, or physical or mental <br /> condition that involves either an overnight stay in a medical care facility, or <br /> continuing treatment by a health care provider for a condition that either prevents <br /> the employee from performing the functions of the employee's job, or prevents <br /> the qualified family member from participating in school or other daily activities. <br /> Subject to certain conditions, the continuing treatment requirement may be met <br /> by a period of incapacity of more than 3 consecutive calendar days combined <br /> with at least two visits to a health care provider or one visit and a regimen of <br /> continuing treatment, or incapacity due to pregnancy, or incapacity due to a <br /> chronic condition. Other conditions may meet the definition of continuing <br /> treatment. <br /> 16.7 Definition of a Qualifying Exigency <br /> Qualifying exigencies include: (1) issues arising from a covered <br /> servicemember's short notice deployment; (2) military events and related <br /> activities; (3) child care and related activities; (4) making or updating financial <br /> and legal arrangements to address a servicemember's absence; (5) attending <br /> counseling arising out of active duty or the call to active duty; (6)taking up to 15 <br /> days of leave to spend with a covered member who is on rest and recuperation <br /> leave during deployment; (7) attending certain post-deployment activities; and (8) <br /> any other event that the employee and employer agree is a qualifying exigency. <br /> 16.8 Definition of a Health Care Provider <br /> "Health Care Provider" means doctors of medicine or osteopathy <br /> authorized to practice medicine or surgery by the state in which the <br /> doctors practice; or <br /> Podiatrists, dentists, clinical psychologists, optometrists and chiropractors <br /> (limited to manual manipulation of the spine to correct a subluxation as <br /> demonstrated by X-ray to exist) authorized to practice, and performing within the <br /> scope of their practice, under state law; or <br /> nurse practitioners, nurse-midwives and clinical social workers authorized to <br /> practice, and performing within the scope of their practice, as defined under state <br /> law; or <br />
