April 9,2013 Page 7 of 9 <br /> 170,000 cubic yards of import. The soil that Shafer wants to export is geo-technically suitable for residential <br /> purposes. Staffhas been working with Shafer,Barr Engineering and the MPCA to assure that the material is <br /> environmentally sound and meets the MPCA's standards for imported fill on the New Brighton Exchange. If <br /> the environmental soil testing is successful,the City would accept this material and enter into a contract with <br /> Shafer Construction. Shafer would then import approximately 5,000 to 10,000 cubic yards of material per <br /> day with the work completed by Memorial Day 2013. There would be no charge to the City of New <br /> Brighton for trucking placement and compaction of the soil material hauled to NBE. The City would be <br /> responsible for all geotechnical and field screening testing costs. Staff recommended the Council authorize <br /> City Project 13-10,NBE Phase 2 Import Soil Project and authorize the Director of Public Works to perform <br /> related tasks. <br /> Mayor Jacobsen questioned how the elevation on the site would change after the soil was imported. Director <br /> of Public Works Wyffels described how the site would be contoured in detail with the Council noting the site <br /> would be pad ready. <br /> Councilmember Burg asked how many soil tests have been taken by Barr Engineering. Director of Public <br /> Works Wyffels commented 72 tests have been taken to date for the soil in place. After these soil passed,the <br /> material could then be moved. He explained the soil would then be reviewed again upon reaching NBE. <br /> Councilmember Burg voiced concern with the contractor stating the City has had trouble with them in the <br /> past and wanted to be assured that City Staff would be monitoring the soil being brought into the City. <br /> Director of Public Works Wyffels understood this concern and explained that the soil would be properly <br /> tested and monitored by Staff <br /> Councilmember Bauman inquired if the MPCA would be involved in this process. Director of Public Works <br /> Wyffels stated the MPCA had testing parameters and State guidelines would have to be followed. <br /> Motion by Councilmember Jacobsen,seconded by Councilmember Samuelson to Authorize City <br /> Project 13-10,New Brighton Exchange (NBE) Phase 2 Import Soil Project (Borrow <br /> Source—Highway 96/US 10) and authorize the Director of Public Works to perform the <br /> following tasks related to this project: <br /> 1. Enter into a contract with Shafer Contracting to import, place and compact up to <br /> 100,000 cubic yards of import material. Shafer will not charge the City for work <br /> related to filling the NBE site. <br /> In addition: <br /> a. Shafer will pay for and install all necessary erosion control items required by <br /> the RCWD. <br /> b. Shafer will pay for any related regulatory permitting costs associated with this <br /> project. <br /> 2. Authorize Barr Engineering to perform environmental testing on the soil material <br /> to be imported into the NBE. Based on the work scheduled, the estimated cost to <br /> complete this task is $16,000. <br /> 3. Enter into a professional services agreement with American Engineering Testing, <br /> Inc. (AET) for geotechnical and field screening services of the imported soil <br /> material in an amount not to exceed $23,635. <br /> 5 Ayes,0 Nays-Motion Carried <br /> 3.Consideration of <br /> 3.
