April 23, 2013 Page 4 of 6 • Implementation of the recommendations contained in the interoffice Engineering/Public Works memo dated 4/9/2013 and attached to the Planning Report. • The applicant enters into a Proof -of- Parking Declaration prior to the issuance of a building permit. • Construction of any of the proposed proof of parking stalls shall require a separate Site Plan and Rice Creek Watershed District approval. • The Landscape Plan is revised to ensure compliance with the 50% deciduous /50% coniferous requirement as outlined in the Planning Report. • The proposed expanded curb -cut most westerly at 1st Street SW is revised to not exceed 36' in width in accordance with Zoning Code Section 11- 020(8)(J). Councilmember Jacobsen requested further information on the curb cut. Planner Gundlach indicated City Code requires curb cuts to be no wider than 36" and the applicant was satisfied with this width She indicated the City Engineer would oversee this issue. Joseph Wolkerstorfer, applicant, discussed the proposed addition in detail with the Council and thanked them for considering approval this evening. He anticipated hiring 10-15 more employees once the building expansion was complete. He explained he would be working to hire and train veterans. Mayor Jacobsen encouraged Mr. Wolkerstorfer to contact the Beyond the Yellow Ribbon organization as it worked with veterans. Consideration of a Joint Powers Agreement with the City of Columbia Heights for Stinson Boulevard Improvements — Fairway Drive to Argonne Drive. Report No. 13 -097. City Manager Lotter commented Director Wyffels was present this evening to discuss the Joint Powers Agreement with the City of Columbia Heights. Director Wyffels stated City staff has been in discussion with the City of Columbia Heights City Engineer concerning concrete and bituminous street improvements on Stinson Boulevard from Fairway Drive to Argonne Drive. This section of Stinson Boulevard is the common boundary between the two cities. Columbia Heights has a concrete street rehabilitation project planned for 2013 construction and a bituminous mill and overlay project proposed for 2014. An agreement has been drafted to define the responsibilities of each City, and has been reviewed by the City's attorney. The agreement defines that: • The City of Columbia Heights shall prepare plans and specifications, advertise and open bids for the projects. • The City Councils of Columbia Heights and New Brighton must approve the award of contract for work to proceed on their respective sides of Stinson Boulevard. • Columbia Heights will be responsible for construction engineering. The extent of work in New Brighton will be coordinated with their City Engineer. • New Brighton will reimburse Columbia Heights for construction costs and 8% of said costs for engineering services. Director Wyffels explained the project would be funded from the City's Municipal State Aid maintenance funds. There would be no assessments to New Brighton residents due to the fact the reconstruction work was considered maintenance work. Staff recommended the Council enter into a Joint Powers Agreement with Columbia Heights for the Stinson Boulevard improvements. 3.
