receipt of such notice, Lessor shall cease all operations which are suspected of causing <br /> interference (except for intermittent testing to determine the cause of such interference) <br /> until such time as the interference is cured. If the interference is not corrected, Lessee <br /> shall have the right to terminate this Agreement for cause, and shall have the right to <br /> seek relief against such provider, including damages and/or injunctive or other equitable <br /> relief, provided that there shall be no liability to Lessor. <br /> Whenever Lessee's approval is requested by this section, such approval may not <br /> be unreasonably withheld, and may be withheld only when the proposed facility of such <br /> other provider would degrade or interfere with the use of Lessee's facilities such as by <br /> reason of RF interference or blocking. <br /> Lessee shall operate its Facility in compliance with all applicable FCC rules and <br /> regulations, including operating within the maximum permissible exposure limits. <br /> 2.06 Interference. Lessor will require all occupants at this location to adhere to <br /> the same technical standards as set forth herein. <br /> In its use of the Premises, Lessee will not interfere with the current or future <br /> operations of Lessor, the communications of public safety or service agencies including <br /> public schools, fire departments, police departments, sheriff departments, or the <br /> communications conducted by public services provided by Lessor such as water and <br /> sewer services. In the event of any such interference, Lessee shall take all actions <br /> necessary to eliminate such interference in accordance with reasonable technical <br /> standards. If any such interference inhibits Lessor's operations on the Property, and <br /> Lessee does not correct or commence to correct such interference within 24 hours, or if <br /> there are intermediate levels of interference and Lessee does not correct or commence <br /> to correct such interference within 30 days, Lessee shall discontinue operating such <br /> equipment (except for intermittent testing to determine the cause of such interference), <br /> on Lessor's demand, unless and until it can be operated without interference, or shall <br /> replace the interfering equipment with alternative equipment that does not cause such <br /> interference. Lessee shall additionally have the option to terminate this Agreement. <br /> Upon written notice by Lessor that Lessor has a bona fide request from any party <br /> to lease or otherwise occupy the Property, Lessee agrees to provide the Lessor within <br /> the sixty (60) days the radio frequencies currently in operation or to be operated in the <br /> future of each transmitter and receiver installed and operational on the Premises at the <br /> time of such request. Lessor may then have a registered professional engineer of <br /> Lessor's choice perform the necessary interference studies to insure that Lessee's <br /> frequencies will not cause harmful radio interference to incumbent tenants. Lessee shall <br /> pay to Lessor a one-time charge for the portion of such studies reasonably attributable <br /> to Lessee's frequencies in an amount not to exceed $1,500. <br /> Lessor agrees that it will require any other occupants of the Property subsequent <br /> to Lessee to provide to Lessee these same assurances against interference, and <br /> 5 <br />
