SPECIAL USE PERMIT ANALYSIS <br /> The applicant is proposing to construct a third silo on the property to house bulk flour. The <br /> height of the proposed silo is 48', identical to the existing two silos. The proposed silo would be <br /> located next to the existing two silos, and setback approximately 5' from the building wall. <br /> Normally, the maximum height allowed in industrial districts is 40'. Section 6-050 (4) was <br /> created to allow certain properties an ability to construct accessory structures in excess of the 40' <br /> standard. The intent of the criteria is to minimize negative visual impacts and to limit the <br /> locations where such structures can be constructed. <br /> Section 6-050 (4) applies the following criteria to accessory structures in excess of 40' in height. <br /> a. The property is located adjacent to the right of way of Interstate 35W. <br /> This criterion is met. The site's rear yard abuts Interstate 35W. <br /> b. The accessory structure is located in the rear or side yard. <br /> This criterion is met. The third silo would be placed in the rear yard, adjacent to I- <br /> 35W. <br /> c. The accessory structure meets setback requirements for principal structures. <br /> This criterion is met. The proposed silo would be setback approximately 170' to I- <br /> 35W, over 230'from the southern lot line. The silo would be blocked to the northern <br /> and western property boundaries by the existing building. <br /> d. No adjacent properties are zoned residential. <br /> This criterion is met. All adjacent properties are zoned industrial. <br /> e. The accessory structure is located no farther than 10' from the principal structure. <br /> This criterion is met. The existing silos are located 5'from the principal structure <br /> and the applicant has demonstrated to staff that the third silo would be located in a <br /> manner consistent with the first two. It is worth noting that an existing small shed <br /> structure will need to be relocated to make room for the third silo. <br /> f. The accessory structure height is no more than 160% of the height of the principal <br /> structure, and in no case more than 50'. <br /> This criterion is met. The proposed silo would be 48' in height which is 160% of the <br /> height of the principal structure, which is approximately 30'in height. <br /> g. The lot area of the property on which the accessory structure is located on is at least 5 <br /> acres. <br /> This criterion is met. The property is over eight acres in area. <br />
