h. The property is in compliance with the performance standards of Section 6-390. <br /> Staff is not aware of any noncompliance issues on the property. Some outdoor <br /> storage is currently being utilized, which is in support of the ongoing plant <br /> renovations. Once construction is complete, all exterior storage must be removed. <br /> i. The accessory structure complies with the standards of Section 8-130. <br /> This is reviewed in greater detail below. <br /> In addition to the standards of, Section 8-130 of the Zoning Code states that no special use shall <br /> be recommended by the Planning Commission unless it shall find: <br /> a. That the establishment, maintenance, or operations of the special use will not be <br /> detrimental to or endanger the public health, safety, morals, comfort of the general <br /> public. <br /> The applicant has stated that the silos will contain flour. Also, two silos have existed <br /> on the property for nearly 6 years without any complaint from neighboring businesses <br /> or residents. As such, staff feels the proposed silo will not endanger the public <br /> health, safety, morals, or comforts of the general public. <br /> b. That the special use will not be injurious to the use and enjoyment of other property <br /> in the immediate vicinity for the purposes already permitted, nor substantially <br /> diminish and impair property values within the neighborhood. <br /> The proposed silo will be located within 5' of the principal structure and located in <br /> the rear yard, which abuts I-35W.. Because of the silo's proximity to the principal <br /> building, only 18' of the silos are visible from Old Highway 8. The adjacent <br /> properties, including the freeway, are located at distances of over 200 - 300' that the <br /> silos will not be clearly viewable. Lastly, all adjacent property is zoned for <br /> Industrial uses and no residential homes are within the vicinity. Therefore staff finds <br /> the proposed silos will not negatively impact enjoyment of other property or impair <br /> property values. <br /> c. That the establishment of the special use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> The adjacent properties are developed for industrial uses consistent with zoning and <br /> guide plan maps. <br /> d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br /> are being provided. <br /> The site has adequate utilities, access roads, drainage, etc. <br />
