Not Approved <br /> Commissioner Nichols-Matkaiti asked if the limitation to 150' in length should be part of the resolution. City <br /> Planner Gundlach stated that could be clarified as a finding or condition, but not necessary because of the current <br /> wording. <br /> Commissioner Danger stated he is not in favor of a chain link fence, and would prefer a sports netting, specifically <br /> designed for golf;noting this would allow the ability to be removed in the off season. <br /> Commissioner McPherson questioned the longevity of a sports netting material, Commissioner Danger was unable <br /> to find that information. Commissioner Shardlow suggested another benefit of sports netting, is the inability for <br /> youth to attempt to climb over. Mr. Westfall stated the netting currently used by the golf course does not seem <br /> durable. <br /> Motion by Commissioner Danger, seconded by Commissioner Shardlow to table the request until the next <br /> meeting; allowing the applicant the opportunity to research an option of sports netting. <br /> 4-2,Motion failed <br /> Ayes: Commissioner Danger and Shardlow <br /> Nays: Chair Howard, Commisisoners Nichols-Matkaiti,McPherson,and Meyers <br /> Motion by Commissioner Shardlow, seconded by Commissioner Nichols-Matkaiti to approve the staff <br /> recommendation as submitted without conditions. <br /> 5-1,Approved <br /> Ayes: Chair Howard,Commisisoners Nichols-Matkaiti,McPherson, Shardlow, and Meyers <br /> Nays: Commissioner Danger <br /> (B) City of New Brighton requests a Zoning Code Amendment impacting the MX, Mixed Use zoning <br /> district, specifically deletion of orphanage as a specially permitted use under Section 6-540 (2) <br /> (E). <br /> City Planner Janice Gundlach reported this request is city-initiated and concerns the list of specially permitted uses <br /> in the MX, Mixed Use zoning district, specifically Section 6-540 (2) (E). This section lists "clinics, hospitals, <br /> sanitariums, convalescent homes, rest homes, nursing homes, orphanages" as specially permitted uses. The <br /> proposed request is to delete the orphanage use from this list. City staff was approached in late May/early June by <br /> Volunteers of America (VOA), who were inquiring about a use they claimed was similar to the uses listed in <br /> Section 6-540 (2) (E). This section not only lists the uses noted above but states that"similar institutions" are also <br /> allowed by special use permit. Through the City analysis of the VOA request, it was realized that orphanage <br /> should be deleted from this Section. <br /> When examining the shared characteristics of these medical related uses it became apparent that an orphanage <br /> does not share any of these same land use characteristics and to lump this use with the others seemed <br /> inappropriate. Staff would recommend deleting orphanage from the specially permitted uses listed in Section 6- <br /> 540(2) (E). <br /> Commissioner Meyers questioned if the "similar institutions" could be deleted; as it seems vague. Ms. Gundlach <br /> stated that could potentially create a problem for other similar uses. Commissioner Danger questioned whether the <br /> City Attorney has any concerns with adopting the ordinance at this time, in light of the VOA request. Ms. <br /> Gundlach confirmed the City Attorney, as a request of an analysis has recommended this change. <br /> Chair Howard asked if the public was notified of the amendment. Ms. Gundlach stated she submitted a Public <br /> Hearing Notice to the local newspapers. <br /> Larry Justin, 1225 Imperial Lane questioned if a "Ronald McDonald" type house would be permitted. City <br /> Planner Gundlach explained a Special Use Permit may be required,if the request is deemed similar,noting without <br /> a specific request she would be hesitant to make a determination. <br /> 2 <br />
