South: single family homes <br /> East: single family home <br /> West: single family home <br /> SPECIAL USE PERMIT ANALYSIS <br /> Zoning Code Section 4-040 (3) (B) provides for specific conditions under which an <br /> encroachment of the required 30' front yard setback may be approved through a special use <br /> permit. Those conditions are as follows with staff responses noted in italics: <br /> a. The proposed addition uses the same exterior structure materials and colors as the <br /> principal structure and accessories. <br /> Yes. The applicant has stated in the Special Use Permit Criteria Worksheet that all <br /> shingles, siding, and trim will match the existing home. <br /> b. The roof is properly proportioned to and integrated with the roof of the principal <br /> structure (dwelling) on the property. <br /> Yes. The proposed elevation depicts a roof that is integrated and proportioned <br /> appropriately with the existing roof <br /> c. The base of the addition is not open and its appearance is consistent with the base of <br /> the building. <br /> Yes, the proposed base will be a concrete stoop and not have any openings. <br /> d. The structure shall not exceed 35% of the width of the front of the dwelling, <br /> excluding the garage, or shall not exceed twelve feet in width, whichever is less. <br /> Yes, the existing width of the home is 46'with 35% being 16'. The proposed width of <br /> the covered entry roof is 5 consistent with the stated maximum of this section. <br /> Additionally, the general health, safety and welfare standards of Section 8-130 must be <br /> considered. A special use permit shall not be recommended by the Planning Commission unless <br /> the following findings are met: <br /> a. That the establishment, maintenance, or operations of the special use will not be <br /> detrimental to or endanger the public health, safety, morals, comfort of the general <br /> public. <br /> Staff finds that the proposed improvement will not be detrimental to the public. <br /> Rather, the addition will improve the neighborhood by adding an architectural <br /> feature intended to protect the entrance from inclement weather conditions, such as <br /> ice. <br /> b. That the special use will not be injurious to the use and enjoyment of other property <br /> in the immediate vicinity for the purposes already permitted, nor substantially <br /> diminish and impair property values within the neighborhood. <br />
