While the applicant isn't constructing any new buildings, the <br />applicant is proposing to demolish 2,990 SF of the existing building lying most southerly on the <br />property. Additionally, the applicant will be installing securing fencing and gates, approximately <br />seven new light poles, and patching and resurfacing certain areas of the existing parking lot. <br />Additionally, the outdoor storage area will be limited to trucks and trailers. <br />Based on the proposed use, staff examined the following applicable standards: <br />Parking Setbacks <br />Section 11-020(6) <br />Required <br />Existing <br />Proposed <br />Front (west) <br />40' <br />—40'* <br />40' <br />Side north <br />5' <br />0' <br />0'— 5'*** <br />Side (south) <br />5' <br />0'** <br />0' <br />Rear east <br />5' <br />0' <br />5' <br />*The site is served by a private drive, which the property to the south also benefits from. Even <br />through the road is within the 40' setback, it isn't considered parking. The actual parking lot <br />begins approximately 40' back from the property line. <br />**Shared access easements exist with the property to the south. In accordance with Section 11- <br />040(7), both property owners are exempt from observing the required parking lot setback. <br />***A Nonconforming Use Permit is requested to address the portion of the northern side yard <br />setback that will not meet the required 5'. Right now, the 5' setback isn't observed for the entire <br />length of the northern side yard. The applicant proposes to saw cut approximately 5' x 222' of <br />the northern side yard in an effort to comply with the Zoning Code. This is discussed further in <br />the Nonconforming Use Permit section further in this report. <br />In summary, unless otherwise noted in the comments above, all parking lot setbacks are in <br />compliance with Section 11-020(6). <br />Required Number of Parking Stalls <br />Section 11-030 (3) (K) requires a minimum of 6 parking stalls, plus 1 stall/500 SF of floor space <br />over 1,000 SF, plus 2 stalls per service bay, plus 1 stall per employee for "auto repair, auto sales, <br />trailer" uses.
