Consideration of Ordinance 835 and a Special Use Permit facilitating construction and use of <br />a helipad on the property located at 1150 Old Highway 8 NW for APi Group, Inc. <br />City Manager Lotter indicated Assistant Director of Community Assets & Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets & Development/Planning Director Gundlach stated AN Group, hlc. <br />is requesting land use approval to install and use a helipad at 1150 Old Highway 8 NW, the site lying between <br />their existing building (I 100 Old Highway 8 NW) and their training center (1200 Old Highway 8 NW) <br />currently under construction. The proposed helipad is 50' x 50' in size and located 90' from the curb of Old <br />Highway 8 NW and 23' from the curb of Northwest Parkway.111e applicant proposes to install a shrub <br />screen, a retaining wall, a sidewalk system, pedestrUm lighting, pilot -controlled helipad lighting, re -use of <br />three existing park benches, nine arborvitae, and preserves nearly all the existing trees. Additionally, the <br />applicant proposes to remove 12" of an old building foundation to make room for the new helipad. <br />Installation of the sidewalk system providing access between the helipad and the licadquarlcrs building at <br />1100 Old Highway 8 NW will result in a net loss of two parking stalls. The applicant is proposing use of the <br />helipad 20 times per calendar year. <br />Assistant Director of Community Assets & Development/Planning Director Gundlach reported staff <br />provided a detailed analysis of the Zoning Code Amendment and Special Use Permit within <br />the Planning Report dated June 12, 2015. Staff finds that with adoption of the criteria in <br />proposed Ordinance 835, coupled with the additional conditions outlined within the Special <br />Use Permit, the negative impacts can be appropriately mitigated. Most notable, is the limitation <br />of no more than 20 landings/take-offs per calendar year (resulting in no impacts 345 days of <br />the year). Those approval findings are outlined in paragraph 11 of the Resolution. <br />Assistant Director of Community Assets & Development/Planning Director Gundlach explained lastly, in <br />an effort to respond to concerns voiced by Commissioners at the Planning Commission <br />meeting, the applicant submitted additional written material addressing various issues. Staff <br />also revised the conditions of approval to include additional conditions that aim to address <br />negative impacts related to noise, wind, and dust during landings and take -offs, including a <br />time limitation (10 minutes) and steep ascents and descents. While these conditions may be <br />somewhat difficult to enforce, they do establish for the record (putting future owners on notice) <br />certain practices for take -offs and landings. These conditions include exceptions for emergency <br />situations and for other safety reasons. She explained that the Planning Commission reviewed <br />this matter at their June 16th meeting and carne to a 3-3-1 vote. Staff recommended adoption of <br />Ordinance 835 and a Resolution approving the Special Use Permit as requested subject to <br />compliance with 13 conditions. <br />Councilmember Jacobsen asked what concerns were voiced by the Planning Commission, Assistant. <br />Director of Community Assets & Development/Planning Director Gundlach commented the take -off and <br />landing time was a concern, along with the noise that would be generated by the helicopter. She indicated the <br />pilot for APi was present if the Council had additional questions. <br />Councilmember Bauman provided infon-nation on APi noting this company had more than 9,000 employees <br />and was one of the top 25 pilot companies in Minnesota.
