Staff finds this criterion remains met. The proposed plan revisions should not have any <br />additional negative impact regarding use and enjoyment of other property in the immediate <br />vicinity. The site design is very park -like and should bean asset to the area. <br />3) That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the district. <br />Staff finds this criterion remains met and the proposed revisions are minor. Most of the west <br />side of New Brighton Exchange is in the process of being fully developed. One block <br />remains vacant, which the applicant has an option on to construct a third office building. <br />There are three blocks on the east side of New Brighton Exchange that remain developable. <br />However, the location and distance of those blocks from the proposed helipad are such that <br />no impediments to development would exist by permitting the helipad. <br />4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />This criterion is met. The revised helipad design does not impact access to adequate utilities, <br />access roads or drainage. The proposed sidewalk connections to Northwest Parkway remain <br />unchanged. <br />5) That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />This criterion is met. The applicant has committed in his written narrative to remaining in <br />compliance with the conditions of Zoning Code Section 6-693(C) and 8-130 as outlined <br />herein. Additionally, the original approval conditions of Resolution 15-046 will be <br />unaltered. <br />To conclude, staff finds the special use conditions of Zoning Code Section 6-693(C) and 8-130 <br />are met. The revised helipad design should have little in any additional impact when compared <br />to the previously approved plan. <br />STAFF RECOMMENDATION <br />Hold the public hearing and accept public testimony. <br />Staff recommends approval of the amended Special Use Permit, as requested, and subject to the <br />following conditions: <br />1) Compliance with the conditions of Resolution 15-046, except as otherwise revised herein. <br />2) Construction of the proposed helipad in compliance with the revised plan attached to this <br />report as Exhibit G dated January 2016. <br />Janice Gundlach <br />Assistant Director of Community Assets & <br />Development/Planning Director <br />
