Staff finds this criterion to be met. The proposed plan revisions do not change proposed <br />flight paths or helicopter type. The minor pad elevation change should have minimal, <br />unnoticeable impact in terms of sound. Changes of the pad surface from pavement to turf <br />should improve upon dust impacts. The hedge proposed surrounding the pad remains; <br />however it must be maintained at a height no taller than 36" (previous plan proposed 36"- <br />42'). Lastly, the center of the pad is in approximately the same location, no closer to <br />residential uses than the previously approved design. <br />8) The applicant secures all necessary permits from other state and/or federal authorities for use <br />of the helipad, including but not limited to the Federal Aviation Administration and <br />Minnesota Department of Transportation. <br />Staff finds this criterion to be met. The proposed revisions were necessary in order to secure <br />a permit from the Minnesota Department of Transportation. <br />9) Because every property has a unique set of characteristics with regard location of buildings, <br />landscaping, and topography, the City Council may impose other conditions not specified <br />herein that are deemed necessary to mitigate any negative impacts resulting from use of the <br />helipad. <br />Staff finds this criterion to be met. The proposed changes are not substantial enough to <br />affect earlier compliance with this condition. <br />10) Special use permit procedures of Sections 8-120 and 8-220 shall be followed except that <br />public hearing notice shall be mailed to each property owner within 1000' of the property <br />under consideration. <br />Public hearing notices were mailed to property owners within 1,000' on February 3, 2016 <br />11) Compliance with the special use standards of Section 8-130. <br />See below analysis. <br />Section 8-130: <br />1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br />Staff finds this criterion remains met. The proposed changes should not further impact the <br />public health, safety, morals, comfort or general welfare. The landing pad design, while <br />larger; remains in generally the same location and is screening from public rights-of-way <br />while not in use. Further, the proposed changes should not have any impact on sound and <br />changing from a concrete pad to turf should improve dust and debris being blown around. <br />The site will maintain aesthetically pleasing landscaping, incorporate a picnic table, and add <br />to existing tree cover on the property. All other use restrictions remain unchanged. <br />2) That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br />
